Also, he had a recent post that made it sound like he's a majority owner in 6th sense? If true, I did not know that.
I'm not the know all but I believe Casey Sobczak is the majority owner and Ben is a minority owner in both 6th Sense & Waterland. I thought Casey was as well. Just weird verbiage to use if you are not a majority owner. Kind of like me saying I own Apple, Facebook and Google. Maybe they are 50/50. Who knows. Good for him if he is, that business has got to be killing it.

Phone call I got about it was that he caught a sharelunker in September and didn’t renew his fishing license so he was fishing expired but by entering the fish in the sharelunker program with a 10k prize this year was considered the above fraud That's what I heard as well. Sounds like TPWD being the POS they normally are. Ben's simple mistake for a couple hundred dollar ticket could cost him the Elite Series if this was to stick. Sounds like you've been on the receiving end as well...

Do people get tickets in a big bass tournament for a boat on fork when their fish measures in the slot or do they go to jail?

(b) A person commits an offense if, with intent to affect the outcome of a fishing tournament:
(5) the person enters a fish in the tournament that was taken in violation of any provision of this code or a proclamation or regulation of the commission adopted under this code.
The applicable portion of the statute is pretty straight forward. The state would need to show his intent to affect the outcome. That's where is think it gets a little difficult for the state when you had another angler submit a fish to the program while not having a license, and not get charges filed against him. The only difference i see between the two from what I've read is one person self reported the violation and the other didn't. If that's the basis for the charge, then seems pretty weak.

He caught it in February. Also the prizes are two $5k prizes, so all he could have won was $5k.
If it was $10k it would have been a felony instead of a misdemeanor.
d. An offense under this section is a Class A misdemeanor, except that if the offense occurred during a tournament in which any prize or combination of prizes to be awarded for any one category for which an award is given, whether the prize or prizes are to an individual or a team, is worth $10,000 or more in money or goods, the offense is a felony of the third degree.

Unless they upgraded it, they charged him with a misdemeanor according to the booking information. You’re fact checking is coming from the place that didn’t even write down the right statute that he broke. Didn’t even yourself write that earlier in the thread?

Nacogdoches County also dated the offense date the same as the arrest date. That probably should have been the day he entered the fish into the program. He has some wiggle room. The difference between the two laws is that they changed 66.119 to 66.023 in 2011. H.B.1806

There was no provable intent to affect the outcome. I would bet that if he had won the drawing he would have declined the prize and had it redrawn. Pretty sure he's not interested in a 5K gift certificate to bass pro. I imagine the company he is a part of donates more than that to TPWD.... Wonder if the DA is related to Alvin Bragg?
