So the fish was DQ’d and he already paid a fine? And then months later here we are? There’s some shenanigans going on!

The charge was not for a fishing license. It was for fraud. The articles I've read said they think he filled out the form and submitted it knowing that he did not have his license. 66.023 - BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: SECTION 1. Section 66.119, Parks and Wildlife Code, is transferred to Subchapter A, Chapter 66, Parks and Wildlife Code, redesignated as Section 66.023, Parks and Wildlife Code, and amended to read as follows: Sec. 66.023 [66.119]. FRAUD IN [FRESHWATER] FISHING TOURNAMENTS. (a) In this section, "fishing tournament" means a contest in which a prize is to be awarded to one or more participants in the contest based on the weight, length, number, or type of [freshwater] fish caught by the participants or based on any other criteria applicable to the fish caught. (b) A person commits an offense if, with intent to affect the outcome of a fishing tournament:
If BASS is looking, I'm sure they are a lot more concerned whether he knew that he had no license when he entered the contest than whether he had the license. Who are you talking to?

I'd like to know now that he has paid a ticket for no license in Texas, is he still allowed to purchase a license in all the other states on the Elite tour next year? We saw what happened to Josh Stracner.

Here would be a good question, in all the tournaments in Texas, all the big bass splashes, etc. I'm sure someone has been ticketed for an expired license. Has any of these people been charged with felony tournament fraud simply because their license was expired in the event? Any of them.

Here would be a good question, in all the tournaments in Texas, all the big bass splashes, etc. I'm sure someone has been ticketed for an expired license. Has any of these people been charged with felony tournament fraud simply because their license was expired in the event? Any of them. The guy in the NPFL that won in Texas without a license was just DQ’d. Nobody arrested him for anything And that was an actual tournament. Share a Lunker is not a tournament and Milliken’s fish had already been removed.

The prosecution will have to prove he knew he didn’t have a license and entered the Program anyway. Unless he admitted that when he was ticketed, or told someone that later, I don’t see how they can prove it.

The next question would be is this some DA in Nac with nothing to do who pushed it or the Game Warden. I seem to recall the game warden up here refusing to charge the kid from the high school fishing team with anything even though they had pics of him getting fish out of a basket in the working man on eagle mountain. Is the game warden the one pushing this?

It may not be the local warden but someone higher up that is pushing this.

Wonder if this is revenge for when he took slot fish home to his private pond from Fayette, which were all clearly slots. In all seriousness, moving forward, is he even allowed to fish in Texas? If not, that’s gonna hurt in more ways than one????

You would think TPW would check for license when they picked up the fish… unless they want it so bad they intentially don’t check until the fish is in Athens

I still buy my combo license the old way around August 31st. Are there license that run from purchase date in Texas? Surely it had not been expired for 6 months..... either way a felony charge is beyond ridiculous for something like this. Give him a ticket and move on. It was a Class A misdemeanor. He may be able to get off because they cited the wrong law. 66.119 was changed to 66.023 in 2011 for fishing fraud in Texas. https://www.legis.state.tx.us/tlodocs/82R/billtext/html/HB01806F.HTMThe articles I've read said he knowingly falsified his entry form. I've always kept my license current. I can't fathom not doing that when it is part of my career. Not to be a stickler for details, the statutes say 10k to be a felony, I just went to the share a lunker page and they show the prize drawing to be 5k.....
