You won't be able to have a 2nd job that competes with a primary job. Our company would file that as conflict of interest...

I just had that training last week. They also claim not getting enough sleep with 2 jobs is a conflict of interest

I think this is a good thing, if it survives court challenges. There are other ways to prevent proprietary information from being an issue than stopping someone from taking a new job at a competitor.
Normally, I think the government has no business taking steps like this, but non competes are sometimes too restrictive (especially in some industries).

My wife has been stuck behind a non-compete for 2.years. It is pretty rock solid according to a company she attempted to get a gig at. It would be a very, very rare circumstance for a non-compete to stand. Courts have always had a strong bias toward allowing people to make a living. My guess (and just a guess) is that the company she attempted to get a gig at didn’t have the appetite to fight it…as most people don’t. Maybe Uncle Zeek can weigh-in and confirm or refute, but I believe that if/when somebody has the resources and they fight it, they rarely lose. Also, the best time to address this issue is when you’re leaving a company. Ask for that language to be removed from your severance document, OR negotiate severance $’s to compensate.

I've battled a few non competes. They have to be ultra-specific, and they have to compensate you fair market value to not compete. Most won't do that, and the contract is more useless than used toilet paper.

I think the signing bonus is what makes a noncompete enforceable. They can sue her for $10K when/if she leaves. I think that's all they can get. A noncompete with no cash attached to it is just a piece of paper.
