If you consider CPS you better be sure of the situation, if your daughter has the children, that there aren't issues with your daughter that CPS will pursue. Personally having dealt with them on a custody issue I would try to stay away from bringing them in. If he had them and you know there are issues with the child’s safety and care then CPS probably is a good way to go.

Record absolutely everything he says. In Texas you can legally record a conversation as long as one party is aware the recording is taking place. Get you and your daughter cheap voice recorders. When recording you need to make sure your side of the conversation is going to be a positive in court. This was absolute gold in my child custody case.

Keep any text messages that help. Be sure you and your daughter keep your side a positive in court.

Search his social media and clip anything useful.

Keep any camera video. Do not redact video or text messages. You can clip out a section but avoid putting clips together for one presentation. A decent attorney could get this thrown out as redacted. You could, be asked if the video or text has sections removed.

When he calls you out that shows his willingness to commit violence.

Do not let him know any of this documentation is ongoing until you have enough to sink him. If he has any sense, once the info comes out, your chance to get more goes down drastically.

I had 239 pages for the child custody and several recordings. One recording of her begging for pot was just crazy good in court.

Finally assume he is doing the same to you. Be careful what you say and do. Clean up any Social Media. Don’t get into arguments where you can’t use the evidence because your side is a problem in court. Generally the nicer you are, the crazier and more agressive they get. You want him acting all stupid.

Be honest with yourself about issues your daughter may have. Potentially they could come out.

Get a good attorney and get a court order.

Rights???? He deserves no rights if this happened and the fact that CPS isn't involved is shocking and you are at risk for legal jeopardy if you know about this lifting the child up in rage by their head and don't report it.

Worked with a guy that shot his daughter's crazy ex dead. He warned the guy if he laid a hand on his daughter he would kill him. He was always a man of his word. The daughter is free of the deadbeat but Chuck did several years for it.
