It is a gray area. They have nothing in the area to compare it to.
What he bought it for is not the value. A person who sees dollar signs will overpay if he has to in order to get something he can improve and make money on.
Its not that hard to address the market value. Its what a reasonable person would think he could buy the property from Todd if he was open to selling it. As it stands Todd is positioned to make many millions on his investment IMO. That is what they should be looking at in the meetings, not just what he paid for it.

They could factor in that real estate is not a sure thing, that at this stage it isn't worth as much to him as it would be when completed. But it is worth more, much more than he paid to get the property, or he would not have offered to buy it.

How do you think its right for him to lose money when the state comes in after the fact and tries to take what is rightfully his?
The laws on eminent domain are clear. The value is market value at the time of the meeting.

In my mind its what a person can expect to be able to buy the place for if he was willing to sell.

I do not understand those that think he should take a loss.

Somebody said the State got an injunction to enter the park. That is not entirely accurate. They are able to go in to do a level 1 survey. They wanted access to do a level 2 survey but the Judge denied it. So they can’t just barge in and shut things down.

Personally I question spending the amount of money it's gonna cost. 200 million plus. So a few miscreants from Fairfield can fish. For that kind of money the state could steal lots of other land all over the place. For a bunch cheaper.

Why do you think that?

The state operated a park there and when Vistra told them that they would put it up for sale the state put a notice on their website saying that the new owner would decide if they could continue or shut down.
What would make him feel that they wanted the park? Why would anyone think the state had an interest in buying the park before Todd said they were going to terminate the lease?

It is pretty apparent to me that the state knew in 2018 that the property was going to be for sale and that they were ok with that. Also its apparent that they did not move to try to take it till after a bid to buy it was accepted.

dont forget it was a no charge free lease the state had pretty sure anybody that bought the property would keep that deal going.

At one time I bet Big Brown paid based on a billion valuation. As time went on and coal became more expensive compared to other fuels the land valuation sank at Monticello. From over a billion to under 400m in 8 years. According to a lawsuit the power plant had the valuation was only $50m just before it shut down.

If Texas takes over the lake it will pay based on what, 100 or 200 million or whatever they pay for it. If Todd wins it will pay based on how successful the development is, maybe a billion.
I think that is one good reason why the county favors private enterprise vs the state.
