What is happening is the inevitable conclusion of this saga. Regardless of who should have bought the property and when they should have bought it, the State of Texas will own and control it in the end. All the "it should have never come to this" stuff is moot, a waste of breath.
TP&WD will end up with the property and Todd will end up with whatever the state has to pay him. There is no other feasible outcome.

first off it hasnt been brewing for years the state got to use the park for free for all these years when their free lease ran out it was sold to the highest bidder for a private development property the market price is set if the state wants to make the todd group whole on this deal great but dont really think the state should steal it from them. after all they have all that money they could have bought it with to begin with so less rthan2% of the state population could be happy. I agree Todd shouldn’t lose money but in the end it may come down to he gets what they want to pay. Chance you take going against the state .

I thought that the Attorney General was the one that had to do the imminent domain action not TPWD.

I thought that the Attorney General was the one that had to do the imminent domain action not TPWD. Nope, it is authorized for use by many state entities and poliical sub-divisions. For example, the AG was silent in regardsto ED on properties related to Boi D'Arc and The other lake...

TP&WD will end up with the property and Todd will end up with whatever the state has to pay him. There is no other feasible outcome. Since this is a one of a kind situation, nobody should assume to know the outcome. I believe it will hinge on when the land is evaluated. If its anytime after Todd acquired it the value could or should be much higher than he paid, IMO.
I am wrong but you can not prove it, you just believe it enough from the bottom of your heart.....

Price will have nothing to do with possession. This isn't Bill and Margaret trying to buy a house beyond their means on their combined $80,000 salary. Texas can pay the compensation awarded to Todd regardless of the amount.
I'm not sure why anyone thinks the cost of the property will affect the condemnation and ownership by the state. It won't. Some of us will apparently be fishing the lake again while other guys are still arguing about how much it costs or that the state should have bought it from Vistra.

Texas is going to take the property. The steps have been followed, and now the state has filed with the court. If some people want to stick with their "it's not going to happen" arguments, that's okay. By all means, hang on to the bitter end and go down with the ship. It's happening. The takeover is in progress right now.

Not sure how an appraiser would justify it much different. Appraisers can't just make [censored] up. They go by comps. And the nearest comp is "it just sold for 100M". There's your comp right there. Future value has nothing to do with comps.

Does anyone actually think TP&WD went as far as to file in court to begin eminent domain proceedings without knowing ahead of time that the money is available, and that the purchase is approved and will be finalized?
They aren't just making it up as they go along.

You may be surprised when rather than approach it from comps of farm land or whatever some of you simple minded folks think, they bring in a list of comps from places like eagles bluff at lake palestine.... gated, golf, in the area..... now what do buildable lots in eagles bluff on the golf course or water go for. Hmmmmmm. There is a reason Todd is marching forward. That math would change the equation dramatically
