Todd can either accept TP&WD's offer or take his chances on the three person Freestone County panel's appraisal. I guess the question he has to ask himself is, "Do I feel lucky?" The three-person panel will not be doing the appraisal. They will get appraisals from licensed, qualified appraisers. Appraisal has more than one meaning.

The guidelines I read only said three uninterested residents of Freestone County.

No worries, just pointing out that Razorback was accurate in his statement that the panel’s “appraisal” means assessment or evaluation of ALL the facts. They can decide exactly as or above or below any formal property appraisals that are made available.

It appears that they use available evidence by both parties instead of getting their own appraisal. They schedule a hearing and let each side present their case. This might have something to do with Aplin being "replaced". Arch H. “Beaver” Aplin, III was appointed to the Commission by Governor Greg Abbott on November 15, 2018 for a term that will expire February 1, 2023. https://tpwd.texas.gov/about/commission

The petition was filed in Freestone County District Court Friday morning, after months of unsuccessful negotiations with Dallas-based developer Todd Interests, which plans to turn the former park into a high-end gated subdivision. The Texas Parks and Wildlife Department wrote in an email that this step was “necessary to pursue acquisition at fair market value to preserve Fairfield Lake State Park and Fairfield Lake for all Texans.” A spokesperson for Todd Interests said Shawn Todd, the company’s CEO, was unavailable to comment. In a previous interview, Todd said his company purchased the land legally and he is not selling. Eminent domain experts say Texas can seize the land because the property serves a public purpose as a park. The battle over the park’s ownership has been brewing for years.

Wrong... This is the current development after the two offers of $103 Million were rejected. I am pretty sure that number is quite different from the $85 Million number I remembered Todd disclosing. Now we're moving forward with the 3 resident panel and the appraisal.

first off it hasnt been brewing for years the state got to use the park for free for all these years when their free lease ran out it was sold to the highest bidder for a private development property the market price is set if the state wants to make the todd group whole on this deal great but dont really think the state should steal it from them. after all they have all that money they could have bought it with to begin with so less rthan2% of the state population could be happy.
