I realize that. It's still a gamble. No one knows if the three person appraisal or the amount he gets on appeal will be more...or less...than the state's offer. He can spend a lot of money finding out if that's the route he wants to take.

The obvious negative here is that has to be factored in to any decision in the future when a land owner considers leasing land for the state to use as a park. They said they won't take it unless the land owner agrees to lease it them but after that they can take it.
How will that affect future parks. Fewer, I'm certain. Remember, Aplin had initially offered a pittance to buy only the state park and before Todd announced his purchase Aplin's highest offer was for $60 million and some tax incentives.
That is about $50 million less than they got from Todd and probably $80 plus million they would have gotten without going through a civil court case with the state.

The three-person panel will not be doing the appraisal. They will get appraisals from licensed, qualified appraisers.
