ROANOKE, Texas (CBSDFW.COM) - The Department of Labor said a Roanoke barbeque restaurant owes $867,572 in back wages to 910 employes after investigators found that it was allegedly not paying overtime and including managers in its tip pool. According to the Wage and Hour Division, the Roanoke Hard Eight BBQ restaurant failed to pay tipped employees fairly by including managers in the tip pool. The Fair Labor Standards Act does not allow employers or their managers to keep tips that workers receive for any purpose. storyWHY would managers be included in a tip pool?!?! This is why tipping needs to be done away with. Pay them what the job is worth! Yeah, not sure why managers part of it. Getting rid of tipping would cost you in higher priced menu selections at full service restaurants. But you save on the tip. Seems it would all equal out.

I work in an industry that tipping is customary...I do not get tipped. Period. It's not allowed, first off, because I am a state employee, second, I am paid what I should be paid. The university keeps a portion of what I earn per client so that I can then do free chair massage events, and buy a $2000 hydraulic table (about $3000 nowadays) so my clients with mobility issues can easily get on the table, etc. My program also helps to pay for more gym equipment, etc. Because I am paid an appropriate amount, I am happy...and I work hard...and in turn, the students and university as a whole benefits. This is how it is supposed to work! Oh and by the way, my massage program is one of the least expensive around...and it still brings in enough to cover my wages, allows me to do the free massage events, and cover the cost of the program. I may be a state employee, but my program pays for itself and then some...and we don't allow tipping.

Happened to Hooters 20 years ago. One of my wife’s friends is a nut and kept all her check outs stubs over about 8 years. They all got paid hooters chicks got a lot of horny lonely men's money to offset their pay

As much as it costs to eat at Hard 8 they should be able to afford to pay their employees…
Only industry I know of you can get away without paying overtime after 40 is trucking. Most still pay it at 40, but Ive worked in places that don’t pay OT till 50 for drivers. Didn’t apply to office, only drivers.

The place I currently work at doesn't pay you overtime either. If you work over your time, you get it "added to your next check," which somehow gets forgotten. About 6-7 years ago, a tree and I got tangled up and ended up with 3 cracked vertebra, ripped up rotator cuff and a concussion. Boss man told me I had to use my vacation time for any time I missed at work. Seems like pretty standard practice now days. Or so I thought. That is a whole bunch of [censored] !

I didn't know that they were still in business. With all the mesquite they use, the meat taste like gasoline. Definitely New York City BBQ. The vegatables and desserts are really really good, though.

I agree with this Meh, this is a rare practice that is hugely stupid and most people know better than to do something so stupid. I cant believe a CPA which they for sure have reviewing their stuff ever signed off on it. The tipping system works just fine.
