Trying to get CS lowered is a damn joke. I literally had to soepena the AG to show up in court. She did, another man hater, but my CS was dropped by 800 bucks, yes I was paying over 1500, if your a single dad in this world you better have some thick skin, it gets ugly

They cannot take more than 50% of your disposable earnings.

He needs to look up his information on the DA site and then call the local CS office that covers his case.

Also, somebody initiated it because no way the DA office would have known he was working another job.

Agreed. Might I suggest this book to help you learn?

Child support should be clear in the decree. 2 jobs does not make double child support. There has been a mistake made by the payroll department of the second job.

I lost a really good employee because of this same thing. CS was taken out of his full-time job, and CS was taken out of the work he was doing for me. His take home with me wasn't worth his efforts to come work for me, even though he was earning $5 more an hour than he could find anywhere else. So he stopped working for me.

As an employer, you have to report all new hires to the state. If the AG comes back with a withholding of 40% of their earnings, you have to do what they say. But if the State is wrong in the wages they take, it's not their problem, it's your problem.

It sux! I hope I never have to be in that position.

He is not behind. I don't know if it is a set amount or percentage amount. But Holzer is right, all new hires are reported to the state. His second employer has no option and has to deduct what the state says. The Texas AG tells him he is now paying forward any amount he may owe in the future (or some BS like that). Since I am three states away, I'm just trying to see if I can help him out with his options.

That being said. I haven't had to pay CS in over ten years. So things may be different.
it should be set at 20% of what he was making at the time of the divorce. 20% would not apply to the second job. Unfortunately getting it fixed might require a lawyer.

I wasn't involved but I remember my Payroll/HR dept dealing with this situation. Took 3-4 weeks before it finally got figured out. Major headache. The company is required to report and comply with AG but fixing an issue that AG creates is a PITA.

Same exact thing happened to my son when he started working a second job. He contacted the AG and they stopped the deductions from the second job.
They said as far as getting any money back he had 2 options.
1 - He could ask her to give the money back
2 - He could wait until the very end and any overages would get adjusted

That money is gone!

Why did you drag me into this?

I do hate child support I see it as reparations for women who use to make less money when the laws were made. There is no family law. Its all a one sided story. I had custody of a son for a year. Never got a dime matter of fact she received money for him while I had him. I had a court order telling child support to to work the case, of course that was never done since it was women working the law. They dont help men.

As for op , my guess is his decree says they take x amount of dollars made. A percentage of his earnings. Probably not a set amount. Make more, pay more. Just like taxes.

20% is 20%

If I make $100 at job A and $1000 at job B it shouldn't matter. At the end of the day she gets 20% of your income.

If you have 7 jobs then she gets 20% of all 7 pay checks.
