Here's who can ask in that law.
Under the law, family, police, mental health professionals can all ask for the protective orders to remove weapons, said Sgt. Jacklyn David, with Anne Arundel County Police.
What's unclear is what process follows the "ask" what evidence is presented, where is it presented and does the accused get their day in court? The article says they get " Red flag calls" which means there is no due process.
You can lose your 2nd Amendment rights. For example a felon can't own or posses a firearm. However they get due process.

Im amazed that people think its ok to loose your rights without a hearing. How can you have a hearing about a person without him being there? Anyone can walk in and say things. Women walk in claim abuse all the time and there handed temporary protection orders then said man gets to court and judge finds outs it was all bs to play games in a divorce. Nothing should be signed by a judge on someones behalf with out both people.
Im not a gun advocate nor do I think no one should have them. I have a opinion but thats it. I keep that to myself. Floorinit, your view is understandable but believe me, these situations aren't as sanitary as your arguments make them sound. Most of the time your locating s person in extreme crisis in the middle of the night or at a time there is no court to appear in for a hearing. It's just not a perfect world out there.

Some people dont need access to guns in certain extreme situations. Period. Easy for some to argue unless it was your neighbor or daughters boyfriend who was the nut job. Again these are the extreme situations.

Again these are the extreme situations. so how does this scenario play out it your head? I call the cops and say my daughter's boyfriend is a nut and doesn't need a gun. Then they go take his guns... sounds great sign me up. We can not be a nation of people living in fear and reacting to these fears. Your job as a father is to protect your daughter from nut job boyfriends. If he can legally possess a firearm, due process needs to be followed to take it away. Due process trumps all, this is one of the founding principles for our nation.
Woke up this morning Got yourself a gun....

I am not sure what to think about this. I am not sure I would have done much different. I would be dead also. I see both sides as was mentioned above I would not want some nut with a gun coming after my daughter either. I would just rather be dead then to give up my rights. I believe we are dead if we don't have our freedoms. We shouldn't destroy our right to defend our selves over someone making a bad choice. I do not trust our judges and politic system to have them make a decision on me. I have no intention to do harm to anyone either, if I do it was forced, don't want to live with it either but will defend my family if forced.

You may not like MR Roachie opinion but it will happened at some point. I know up here in Wyoming they had local police talk about this very thing and decided they would not try and disarm the local people not sure they could anyway. This is going to get bad before it gets better and no one wins this, in my opinion.

I find it strange that there are so many people who think its ok for a select group of people to make decisions about the vast majority of people and they are willing to lay down and say oh ok your a authority figure. The whole judge making decisions is bad enough when you go and they only get a small snapshot of the whole picture but now they can take away your guns without you even coming to court and hearing your side!
Just so people know I dont own a single gun probably wont ever again. But I sure believe I live in America and if I want one I should be able to own one. I for the most part abide by all laws. Occasionally get caught speeding not because I speed, but because I got caught up in a speed trap. I normally dont speed on purpose. Dont smoke, drink or do drugs. So no I dont really need a select group of people making decisions about me as Im doing right by society anyway

They just said a judge ruled and signed a warrant. He may have been innocent and just didn't want to give up his rights to. I guess if that is so they did go after his guns.

It ain't worth threatening the law........... trying to do their job. Unless you are criminal. Or a nut that pulls a weapon on them.

It ain't worth threatening the law........... trying to do their job. Unless you are criminal. Or a nut that pulls a weapon on them. The point is they may have made a bad law and people are not just going to give up their guns because a couple law officers come over and tell you to give up your rights. This is exactly what gun owners are scared of. To easy for someone to say you have a mental problem and here we go. I don't want to see this happened but here we are. The police should think about this before going in to take peoples rights. I do not see a good out come to this in the long run either. I have a friend who was a 30 year local police officer in the Texarkana area and what he says about local police is scary.
