Buddy of mine had a less than a year old Phoenix 920 that the hull started separating in the floor and the transom, he was making big payments and they kept it for about 5 months to repair it. Would not replace the hull. Admitted it was their fault but still he was stuck with payments and no boat for a long time. I hate to hear about your situation but your not alone and it doesn't matter what brand of boat it is, you cant make em do what you want them to do.

Its an alum boat. Uneducated lousiannanians been beating them up for hundreds of years and are smart enough to weld them and go on about their day. Id just have the cracks welded for a few hundred bucks and never buy another BPS boat again instead of be without it for years.

It aint rocket science its aluminum. Have it welded and get back out there
The manufacturer doesnt care that you make payments. Thats your decision, to take a loan not theirs. Theyre not legally responsible for you having to get a loan to buy a boat. Sucks but the way it is.

Sadly there isn't much recourse when it comes to boats. Lemon laws don't apply and if you read the fine print of the warranty from most all marine manufacturers they all have the same blanket statement, "repair or replace at the manufacturers discretion". Worst part is there is no disclaimer on a timeframe for them as well. Usually though better manufacturers will offer an extended warranty with the repair.

use the lawyer card as a last resort if you read your warranty which not very many folks do all the remedies are in the manufacturers favor when you mention lawyer they have a lot more of them than most folks do.

Never bluff with the lawyer card, they have corporate lawyers and many of them! Be ready to play ball if you mention lawyer as a bluff.

This would be my route. I would do everything in writing too. Especially if you financed it through Bass Pro.
I would also get their explanation they first gave you on writing. Especially the part of the admitting it is their fault.

Be patient and persistent. BPS will make it right; they did mine and it was out of warranty.
- Get your ducks in a row.
- Seek out the top man to go to.
- Yes, go to him and set down and talk.
- Make lots of pictures to take.
- BPS has repair centers all over the state for you to get opinions of what needs to be done.
- Get that statement from that repair center to take with you.
- Take the attitude that the customer is always right.
- Be prepared to tell them what you want. I would want a new boat; plain and simple. 6 mo. to a year in house repair is unacceptable.
- They like to hear that you would like to upgrade and pay the difference. Move to a better boat in other words, at full value of your damaged boat.
- The ball is in your court now. It is up to you to put the monkey on their back. Do your homework and get started. Advice from a Lawyer on how to handle the situation is not a bad thing; just don't make any threats that cannot be backed up. Knowledge is king; but it is hard to find a lawyer that is versed in this kind of thing. Most will tell you they will handle the problem then blotch the whole thing, causing more problems.

For everyone that is saying - "They have more lawyers", I can assure you that their lawyers charge much more per hour then most lawyers you may go to and they would prefer not to go that route. Also, depending on the state the burden of proof can be more difficult for the corporation rather than the consumer. You have to be prepared to pay quite a bit out of pocket for your lawyer should they try to fight you, but most large corporations are not going to fight you over 6 months of $200-300 boat payments. Actually, most local managers will be pretty sympathetic to you as they are the ones who deal in the community so you may just start with a conversation there and see how that goes.

Know that once you mention lawyer all negotiations will stop. I would avoid that word until you reach a dead end.

First of all this whole situation sucks but I am so dam tired of the lawyer up people in this world. There is nothing they have done that is illegal, fraudulent, etc. It's simply a defective product that needs to be fixed. As some others have stated, the way to approach this is through the chain of mgmt either at the store/dealer you bought it from or BPS customer service because this situation is obviously ridiculous. My guess is if this is handled professionally and cool headed they will find a way to make it right for you.
