i would say consult your attorney, then call the sheriff to go with you to show you mean business and give them 48hrs to comply or they will be evicted and lose their deposit...otherwise they are the boss...just my two cents....

Because there's all kinds of laws in place for landlords, but they only protect you if the tenant is actually on a written lease. Otherwise it's just your word against theirs.

IF you file evicitons, it will take about 45 days after court to get sheriff to call you and meet you over there to actually do the eviction if they decide not to leave. Kinda can be a pain but once the sheriff arrives with you they are gone and all there stuff is lost if they don't get it out of the house/apartment right then.

your home, your rules on the lease, your BUSINESS interest at stake.

if they are good tenants then go talk to them and explain that you need the paperwork NOW or will be filing eviction for non compliance with the lease terms.

business is business, you have no friends in business dealings.

Give them notice the lease is violated so as of now the rent is going up $500 a month. As soon as all paperwork is filled out and background checks are done and new lease is signed the rent will go back down $400. Charge $100 extra for the extra person.

I see both peoples sides here. I get it! But if he just raised the rent he would be no different then the tennant. He wouldn't be following the contract he offered up for tennant to sign. Claiming insurnce needs to know who's all there is just bs. Insurance only cares about owner. And his ability to pay his rates. Insurance will never pay a tennant for losses. insurance don't raise and lower rates based on the tenants credit history. The renter signed a lease he should follow it. You never know why the new person is there. Could be a variety of reason. As someone said earlier. Just cause a person doesn't have a felony doesn't make them good. It also doesn't make everyone bad. I know a guy has no felonies. Yet writes bad checks all the time. He knows how and who he can write them to and how the legal process will deal with him. He basically bounces checks knowing they will goto collection and be able to make payments. He acts like checks are credit cards.

Ok. I have been going back and forth with them for a few days now. I won't go into too much detail here but I am renting the house out to someone as a favor. I am not making any money on the house and am actually losing about $100 a month on the deal but the person living there needs the help and I didn't mind it at the time.

On top of that, the person living there has had a lot of health issues and fell behind on their rent and owes me $3500 in back rent.

So needless to say that I do not want another freeloader living there. If he has a good job and can help her out and pay more rent than that is fine. I was planning on raising their rent $300, which is still $600 less than market value for the property, if his background check was ok. But after checking his background, I don't think he has a job and was in the stages of being evicted 3 times before the apartments he lived in finally evicted him. I think this situation will just get worse for the original tenant and I am just tired of all of it.

Time to make a business decision. Here's some food for thought though... the Toyota HQ campus will be opening up in Frisco starting early 2017. Supposed to be 12,000 jobs there, and roughly half of them are relocating from California.

Maybe you should tap the brakes for a few months and try to have an empty rental in January to take advantage of what is bound to be a big rental demand.

They are moving Liberty Mutual from up north and building right next to Toyota and I think they are suppose to have 5,000 new jobs.

I think if you throw Fed Ex in there then that is where the 12,000 new jobs you are talking about.

That may be right. The main point is that there will be a whole lot more people looking to live in the far North DFW areas next year than there is today.

With Toyota, State Farm, and USAA making moves here, there will be plenty of people looking for homes that is for sure. I just hate helping someone out and then having to kick them out in worse shape than they were when I started helping them.
