Seriously? LOL. You need a reality check. If someone breaks into your home, you are FREE to shoot on sight and will be acquitted of any wrong doing. Remember Barry is the victim here. He has a right to defend his property and person, not just his person. And for the record you can joke all you want about harming suspects. If someone like you takes it as a terrorist threat, then you sir are what is wrong with society today. Sad Day.

Well, if someone breaks into your residence (not garage) or attempts to take you, you can then use deadly force. Also, "terroristic threat" is just a term, it does not literally mean a terrorist making a threat. People have gone to prison and received felony records for saying "I will kick your ***" (non-verbal threats too). I am just trying to warn people for future reference.

You might want to look up deadly force laws again, as well as preceding cases in which the citizen is charged (not everyone gets acquitted). Again, I made sure to be clear that I am not defending the suspects. I know exactly who the victim is. Also, I have lived in Texas my whole life and support the GOP. I am just not gung-ho on killing a human without an actual threat; regardless if it is lawful. I do not believe I am a problem to society, just trying to tell people of an unknown felony that ruins one's life.

I am not trying to get into arguments. My intention was to inform people of a crime they may not know they are committing (regardless if it happened here or not). I just found this law interesting and thought I would share. Sorry for offending everyone. Also, sorry if I came off sounding like a liberal nut, I'm not.
I am not an expert of Texas law, so the deadly force comment was just my understanding (I still do not understand fully). Like some CHL instructors, I do not think killing someone is worth the stolen property. These are my opinions, and certainly do no think they make me a problem. Sorry to Barry for creating heat on the thread, I hope they catch the thieves quickly.

This is just the reason I am always armed and after getting a bullet put through me several years ago I would have no problem pulling the trigger on someone who needed it. I had someone try to steal stuff out of my boat 5-6 years ago what I learned from this was not to pull the triggers on a double at the same time.

Well, you couldn't be more wrong. I'll post a small subset of what Texas law actually allows:


PENAL CODE

TITLE 2. GENERAL PRINCIPLES OF CRIMINAL RESPONSIBILITY

CHAPTER 9. JUSTIFICATION EXCLUDING CRIMINAL RESPONSIBILITY

SUBCHAPTER A. GENERAL PROVISIONS

Sec. 9.42. DEADLY FORCE TO PROTECT PROPERTY. A person is justified in using deadly force against another to protect land or tangible, movable property:
(1) if he would be justified in using force against the other under Section 9.41; and
(2) when and to the degree he reasonably believes the deadly force is immediately necessary:
(A) to prevent the other's imminent commission of arson, burglary, robbery, aggravated robbery, theft during the nighttime, or criminal mischief during the nighttime; or
(B) to prevent the other who is fleeing immediately after committing burglary, robbery, aggravated robbery, or theft during the nighttime from escaping with the property; and
(3) he reasonably believes that:
(A) the land or property cannot be protected or recovered by any other means; or
(B) the use of force other than deadly force to protect or recover the land or property would expose the actor or another to a substantial risk of death or serious bodily injury.

Acts 1973, 63rd Leg., p. 883, ch. 399, Sec. 1, eff. Jan. 1, 1974. Amended by Acts 1993, 73rd Leg., ch. 900, Sec. 1.01, eff. Sept. 1, 1994.

Sir, I would absolutely learn the laws. But, if you read one of my other replies, you would have seen that I admitted I did not understand Texas Law regarding the subject. I was just going off of what I have heard my whole life. I did research afterwards and learned the laws contradict what I had been taught. But remember, the laws apply to a personal residence, even the garage does not count (I read from Texas Attorney). So if someone is outside stealing your kayak sitting in the driveway, you must feel your life is in danger. Though, I would not take my information or another's information with much regard unless that person is a Texas attorney. Just because the law states one thing, does not mean that is how it is interpreted in the court. As well, you have to be aware of federal laws, as federal law always supersedes state law (constitution).

I personally would not kill someone unless I felt mine or someone else's life was in danger. After all, it is not a simple concept to grasp - killing another human.

Sorry for causing argument on the thread. Some of the comments just got under my skin.

I am not even sure of the personal residence aspect, I just read a small article written by an Attorney. Plus, much of the laws posted here mention nighttime.
