I would sue. There is no reason for the bottom to rip off a 2008 35k boat if it has no prior damage..,,period. Warranty or no warranty. You would think they would want to do test with your hull to find out how/what happened in order to make a better product. That makes me think they have seen it alot.

On another note have you guys seen the Toyota commercial where they take a year old Tundra with 100k miles and strip it to tne frame to check everything on it....,way cool i thought

I have taken a capture of all of the responses of this thread and pulled them together to forward on to Tracker Marine. In addition, I prepared a final letter summarizing my situation and asking for one last final review. I have sent this info to the following:

-The local dealer that I took the boat to for evaluation
-The head of the warranty department at Tracker Marine
-A contact in Customer Relations at Tracker Marine
-Katie Mitchell in Public Relations for Bass Pro
-I also took a guess at Kenneth Burroughs email based on the other Tracker Marine emails I have

I will let each of you know if/what response I get.

As stated, a hull should NOT break in half without some sort of impact. If Tracker cared about their customers and building a loyal base, then it would seem they would at least give him more than $2,000 towards the purchase of a new boat.

I am not being critical, just curious. Why post this on the forum before trying to go higher in Tracker management or BPS? At this point, BPS and Nitro have taken a huge hit in brand image. In other words, the damage (to the Nitro brand) is done and there is no bullet left to shoot other than legal action or displaying the boat at BPS events, etc. It seems to me that the threat of posting this would be enough for BPS/Tracker to more adequately respond but now the damage is done. BPS/Tracker may fight this now that this is out regardless of whether they win or lose? There is no doubt this has caused future lost sales and current Nitro owners a loss in resale value.

I am no lawyer and certainly don't know Nitro's warranty but if it does contain a statement concerning the number of owners and this boat fall into that category, it seems by the letter of the law, the boat is not covered under warranty. Whether the warranty is fair, below industry standard, or right or wrong seems irrelevant.

I truely hope this gets resolved.

I have always been told that a satisfied customer might tell people he knows about a company's performance but a unsatified customer will tell anybody who will listen and then some.

I would have posted this in a heart beat. First as pay back and second to warn others. The more attention something gets the more weight it has to fire back at the company who is giving you the fingure.

I am glad to see this this post. People need to know what to expect from a company and when your thinking of spending 20K-50K on a boat you can bet I want to know info like this.

Standing behind your product is a hugh deal. Warranty or NO warranty this should not happen and they have to know it.
Just my 2 cents.

Was this yr model and brand of boat recalled? I never heard about it.... A car's engine shouldn't lock up either but it happens and if not under warranty its the owners responsibility. The boat wasn't under warranty. He was the third owner. He took a chance and he learned from it. I'm gonna take my Skeeter down to Fun N Sun and demand they replace the seal thats leaking on my hydraulic steering. Nevermind the fact its an 01 model.

Bottom line is the warranty is out. The buyer knew it when he bought it. It sucks bigtime for him no doubt!

I believe they would've stood behind their product if it was under warranty.... I'm not trying to defend Nitro too much here at all...I'm one of the guys that rips the straps on the compartment doors everytime I wanted to check out a new one at BPS which is why I own a Skeeter.

I just read the whole thread... I need a stiff drink... I'm afraid that all Matt did is back Tracker into a corner, they can't win now no matter what the do. He should have went up the chain of command first, then posted here and other sites. I hope everything works out but I feel Tracker will now dig in for a fight and I'm pretty sure Tracker has more lawyers than you can shake a stick at.... Not good for anyone who has a dog in this fight... Dan

To me manufacturing defects are or at least should be outside the scope of a normal warranty. From what I have seen posted only one fiberglass repair shop has examined the boat and they stated there was no impact damage. If they sold something that was already defective, they should have to fix it regardless of who the current owner is.

I haven't read all 17 pages but my only question is since it was bought from another person was there something they could have noticed before they sold it to you? Thats why I try not to buy used cars from people if possible. Friend bought a BMW for 10K cash and transmission went out less that a month later. I bought a dodge stratus cash less than 5 months its transmission went out.
I have a new bass tracker bought in May '10 a few issues with the trailer but they fixed most everything on the spot no cost to me other than gas. Only exception was water pump got dirt in it which was probally on me and I believe I even know when/where it happened
