I have heard you can't be charged with DWI if you drink alcohol in sight of LEO< right before taking a DWI Test.

Make sense to me, but never had a lawyer or judge ruling on it

This was a loophole in Virginia where my dad is a lawyer. It was closed.

I had a buddy that used to keep a glass bottle of vodka filled with water under his seat. If he got pulled over he was going to step out of his car show the bottle to the dash cam and down it. He was kayaking and got flipped over and wedged between some rocks. He drowned and never got to try out the vodka/water slam. True story.

You could still be charged. The case would have to be strongly based on your observations before the stop and field tests at the time of stop. The case would have to be made that the beer you chugged wouldn't have had time to effect your performance. The breath and or blood test would be rendered irrelevant.

1shot, to answer your question, yes. He should be an OTer if he’s not already.

I’m pretty sure he could raise the mojo level up to 11. I bet he has a truck crockpot, and an aluminum boat.
