Selling a Park Model @ Lake Fork

For those of you who have bought or sold a Park Model at Fork. We pay an annual lease for our lots. We're selling our place at Fork and seems the buyer has to re-up for the full year's lease. Even though we have 8 months remaining on the pre-paid lot. Is this common in other parks on Fork?

It seems every time one is listed on TFF the remainder of the lease goes to new owner.

Is the lease transferable, I would expect it to be dealt with on the paperwork.

Pretty sure our lease rolls over to the next guy. Meaning the new buyer doesnt pay until my lease runs out.

Im pretty sure mine does not roll over in The Fishing Hole...new part of Popes!

new owner should pay you for 8 months and the owner for 4 more months, giving the owner a new 1 year lease.. I would roll the 8 months into the price, or split it or negotiate. I understand the owner wanting a year with a new tenant..

Paperwork can be changed on a lease. Seems pretty greedy to me unless theyre going to refund you.

I'm not sure that they can actually do that even though they might have put it on the paperwork. You would still have rights to use the property for 8 more months even though you would no longer have a trailer and they'd be selling a new owner the rights for the same property use for the same 8 months. For instance, I know if you rent a hotel room for a week and leave after 3 days, they can't charge you for the room the remainder of the week if because it is vacant, they rent it out to another guest. They may charge you a penalty for leaving early but can't legally collect rent from 2 people for the same unit.
Jim Sr. seems right as to they should want a new lease from the new owner and reimburse you for the 8 months paid minus some type of early cancellation penalty.

sounds like they are trying to make money off you. Like a profit deal or something. Actually I've never heard of the prepaid rent not transferring to the buyer but the buyer does have to still apply, get background checks and basically qualify to take over the lease.

Thanks for the replies. Our lease does not address this either way. You know what that means We paid $2,400 for our lot, which runs though December 31, 2018. We have a buyer for our Park Model, but the landowner is going to keep our $1,600 (8 mo.) and charge the new owner another full year's lease on that lot. Therefore, we were forced to drop our selling price by $3k to keep the buyer whole. Is this common around the lake? Other than the new part of Pope's?

If its not in the lease agreement I cant see how he can do it. These types of things are why they have small claims court.
Your position after its all said and done should be exactly the same as if you were paying month to month.
