If it's first offense and he has no other criminal record, a good attorney may be able to get him deffered adjudication. In the past you could get deferred adjudication for a first offense with no priors but that is no longer possible if the crime is a dwi/dui. I know a young man who got it a couple years ago. How, I have no idea but I'm sure $$$ were involved. It's possible he got deferred prosecution, but not deferred adjudication. DUI/DWI are the only misdemeanor on the books for which you cannot receive deferred adjudication. A new law was passed last year that is supposed to have a similar effect, but the state took away deferred adjudication for dwi offenses back in the 1980's.

If it's in Collin County, I bet it's closer to $15-20k before its all said and done. He may also lose his license for 6 months to a year.

Unfortunately, he will not have a good outcome. A first DUI would wreck my life because I would lose my job. I would not be authorized to drive a company vehicle, therefore, I couldn't do my job. I'm sorry to hear about your brother. Some people just learn the hard way, or never learn. GL to him!

He should have used Uber. Word up! $10 or $10,000 and possible time in jail... Easy call! A sober ride will be there in less than 10 mins. Likely under 5 mins really. BUT whats done is done. Hopefully hes ok and he REALLY learned his lesson this time.

ITs going to be a long +/-18month non stop stress, writing lots of checks, court appointments, and attorney meetings. The court system loves DUI's because it makes huge amounts of money to feed the machine.

I had a Houston LEO tell me that most of the folks they arrest for DUI can't afford UBER. They have limited incomes and would rather spend their $ on booze than getting home safely.

And normally pled down to a misdemeanor

If he does not get another one in the next several years the state past a law that you can have it removed from your criminal record after probation and other good stuff he will have to do Its number 2, but the other was like 8-10 years ago That changes things. all the above

First offense is normally a class b misdemeanor. The DWI can be a felony under certain circumstances, like if a child under the age of 15 is in the vehicle.

DWI are a joke my stepson has five of them three in Denton county two in Cooke County just went to court last week should be five to seven in prison he got thirty days in jail and five years probation and that is the longest time he ever spent in jail.
