I’m in the market for my first suppressor. I thought in addition to the tax stamp you had to have a trust. I just found out the trust is optional. Should I set one up? What are the benefits of setting one up and putting the suppressor in it?

use the silencer shop, they have kiosks around that you use for fingerprints etc. and you can do everything there then they submit thru the new efile. sposed to only be about 90 day wait now, I will be getting my first next week and using the kiosk. they have a one shot trust which is the fastest easiest to do but it is for a single purchase, they have another that can be used for the next buy etc. https://www.silencershop.com/how-to-buy-a-silencer

No trust needed. Originally there were good reasons for a trust. But they closed all of the loopholes since then. Biggest problem was having local LE chief sign off. Big cities didn’t have time to mess with it. Now no local LE sign off required. Also before you could name users and heirs in trust and they didn’t have to get fingerprinted and go through process. Now anyone you name has to go through process also.
Find a shop that has a silencer shop kiosk and fill the paper work out. Pay the fee and wait. You must buy the suppressor you want first.

I have a trust for mine. This allows me to add a person to a trust and let them use it without me having to be there as well. Wife, Kids, etc. I have talked to a few lawyers about the SS Kiosk trust and there are some scary holes in that trust that I will not expose myself to. My trust was formed and filed by Uncle Zeek, send him a PM and ask your questions to see if you should trust or not, and what route you want to go.

Not exactly true... People can be added as a trustee that does not require first going through the NFA check. It is only who is named on the trust at the time of submission that is subjected to the fun and games.

Thanks everyone. I thought about adding someone so they could use it without me being there but that would only be my kids, and none of them are 18 yet. I was told they need to be 18 to be added. Is that true?

Yes you can name users on your trust. I was referring to being able to name heirs. Sorry. My 16 year old sons are heirs on my trust.... there are provisions for this that require to be of legal age, but the trust can name heirs under the legal age. This is why I say to talk to a lawyer that is in the know of the NFA world. Mis-information spreads like a california wildfire and can be equally as damaging.

In my opinion, the laws on suppressors are intentionally cloudy. I'm not sure you'll ever find a law enforcement official that can even decipher them enough to know with certainty whether or not you are in compliance.
I'd recommend a trust, and I'd recommend finding a lawyer to set it up as opposed to doing one of the quick and ready options from a seller of suppressors. My main thinking around this is that it shows you are doing everything in your power to follow a very confusing set of regulations. To me the kiosk versions of a trust would be like filing your taxes on a ready made form where you just change your name and address. The kiosk is great for all the other paperwork, just not the trust IMO.
You are mainly trying to protect yourself from having your suppressor getting confiscated and held for several months while you prove you own and use it legally. If your kid ever gets stopped by a trooper and he see's a suppressed rifle in the back, or if he gets checked by a GW in the field, you can have a stack of trust paperwork to throw at them to show your legality.
