Just looking for some direction on where to start my next big project. My family and I are looking to build a 20-30 acre private lake on our farm which is between Sulphur Springs and Emory in Hopkins County. The farm is about 170 acres and there are two creeks that run through it.

I have read online about the state of Texas requirements, soil testing, and such needed. I would like to work with (pay $) someone upfront to plan things out, evaluate options, etc. as I know this will be an expensive journey.

Mike Otto with Otto's Dirt Service. He is up near Gainesville so he probably wont build it but can design the lake for sure. It will be more than just a hole in the ground.

I would put a call into the owner of Camalot Bell and see if he has recommendations on build a pond that size.

Good luck with your pond building they are very pricey.

So do you have to go through all the mess of "building it to state code" because you will place it so that either or both creeks feed the lake that you build and the water in the creeks belongs to the State of Texas?

Or is the state involved just due to the size of the potential body of water?

Just asking from the stand point of if you own the land, and you want to put a big hole in the ground, then why does the state need to be in on the project.

Section 11.142 of the Texas Water Code allows a person, without obtaining a permit from the TCEQ, to construct on their own property a dam, pond or reservoir storing not more than 200 acre-feet of water for domestic and livestock and fish and wildlife purposes. ... Exempt ponds must be used for non-commercial purposes.


If you are over 200 acre foot of water it gets complicated.

I would recommend having a discussion with an engineering firm. In addition to the State rules on 200 acre foot impoundment limits, because you looking to dam up creeks you may have a US Army Corps or EPA issue if you have what are considered "wetlands" or "navigable waterways of the United States." I am dealing with a situation in East Texas where a neighbor built a +200acre foot impoundment, didn't have it engineered, the dam failed and significantly impacted downstream people. Needless to say it is a very expensive and nasty piece of litigation now. I can refer you to the engineers we are dealing with if you want to PM me. Measure twice on this for sure....

I wouldn’t dam any of the creeks, you can’t control what gets in there when it floods.

My brother has a 5 acre tank that was built off a dammed up creek bed, now it’s loaded with gar.

He didn’t build it, bought it that way and didn’t realize that had happened til after.

I wouldn’t dam up a creek. You’ll be cutting off a downstream landowner who will need that water for livestock.
