Eminent domain, for the most part, is a terrible program. Acquiring property legally is one thing for the public need, but taking someone's home for a sports venue (AT&T Stadium in Arlington), or someone's home for a shopping mall (NE Mall in Hurst), or someone's family farm for a casino (Winstar in Oklahoma) is just so wrong.

Yep, roads are one thing, if you didnt have it none would get built. Malls, parking lots and stadiums are a whole different deal.

Many problems with Eminent Domain. The biggest is the "fair value" part. It should be at least Market Value plus 15%. That way you are adequately compensated for them stealing your property. Most court cases are about the "fair value" that they try to pay you.

I might be needing one as well as they are going to widen the state hwy behind my house. However the city I think has worked a deal to take this section from the state in a road swap so I don’t know who I’ll be dealing with yet.
