I’m guessing that the deed restrictions are referring to permanent buildings or structures built on the property. If that is the case, will a container fall under the category of permanent structure?

Oh, one other note on covenants & restrictions in general. You need to look at the deed restrictions and see who they are between. If they're strictly an agreement between the grantor & grantee of the land, then third parties like neighbors may not have any standing to get involved. Dang, I bet Zeek is right...it would be unlikely they would have deed restrictions that are binding between anyone other than those two...maybe I'm wrong...

Unless you understand exactly how restrictive covenants work (and I'm guessing no by the fact that you posted here ) take your documents and talk to a real estate attorney and know your rights (if any) going in to any discussions. BTW oftentimes restrictive covenants will allow for attorney's fees for the enforcing party.

When you asked the owner about moving his container box what did he say? I havent got that far yet, Its on my list to have a neighborly chat. My work schedule hasnt been conducive. I dont think7 am or 10 pm is the appropriate time to go door knocking

Unless you understand exactly how restrictive covenants work (and I'm guessing no by the fact that you posted here ) take your documents and talk to a real estate attorney and know your rights (if any) going in to any discussions. BTW oftentimes restrictive covenants will allow for attorney's fees for the enforcing party. I have a real estate lawyer buddy with an addiction to blantons and no supply. He is gonna do a read over and advise before we go forward. It's my sincere wish that this be handled neighborly as that guy has lived there 20 years and I have been there 13 years. No reason to get nasty, would prefer to work it out. For that matter if it was a matter of cost let's just sell the container, let me throw in the difference for something a little less unsightly and March forward in a happy way. That's how nice I am willing to be

It looks to me like there is space to move it back behind the trees and you'd barely be able to see it. Move it back and paint it green or brown and call it a day.

You would like to think that, it is a generally nice area and I'm surprised he would have done that. It doesnt fit, other than the filthy hippie that lives a mile away everyone generally act right. The hippie is clearly insane and hopeless.
