What what is the process for having covenants and restrictions enforced on a property in unincorporated area of a county. The county has no code enforcement department

what are they violating and where are the covenants/restrictions recorded?

if city then they have a bldg dept most likely, start there.

if county, be real sure of what they are doing wrong or get sued. counties have almost no code to have to live up to, septic, electrical feed and wells are about it.

if state then have the dept. and specific violation in triplicate and go see the court clerk, I think constables do all that dirty work but court has to order it done.

if deed covenants/restrictions then the court room is going to be in your future.

This is my new view from front porch, not 18 feet off side property line, past his front build line and not new material. All deed restriction violations.

Time to do some research at the County.
1:Find the original covenants and restricitions covering the property that were recorded
2: see if the original covenants and restrictions have ever been amended; if so, get copies of all ammendments
3; make sure that the current owner of the property in question were given copies of the covenenats and rerstrictions and any ammendmenrts.
4: find out if the person(s) that filed the original covenants and restrictions, and any amendments, still have any interest in the property and contact them.

Once you know all of that and there is still a problem Zeke's advice may be the next step.

If there is still a Mortgage on the property you could try to contact the lien holder and make them aware of the fact that the property owner is in violation of the covenants and rerstrictions. There is usually a clause in a Mortgage (Deed of Trust in Texas) that requires the borrower to follow the reestrictions.
