I’ve been lucky so far and haven’t had to deal with insurance for an accident except once. My luck ran out today as my wife was at an intersection and got rear ended. It did enough damage it will be at the dealer for a few days.

The other lady had insurance and it was obviously her fault. My question is, does her insurance cover any type of depreciation since the vehicle will now have an accident against it? Seems like when I go to sell it and they run a car fax it will show up and therefore be worth less. Or am I just SOL?

you can try to negotiate some cash on top of the repair but doubt it would be worth the time and effort unless you stand to lose thousands.

It’s a 2018 Infinity QX80. I was thinking of pulling some comps online of the difference between the same vehicle with and without accidents. Or asking the dealership to tell me the difference of trade in value.

hit the dealer for a real world estimate, make sure they know why you are asking.

I'm guessing you are SOL, but unless their was frame damage it shouldn't really matter.

I learned the hard way that unless you have a police report or a written admission of fault from the guilty driver, don't assume that their story will not change and their insurance will fight responsibility for your claim, especially if they have Allstate.

Worth less, and worthless are two different things to me. I just know if you shop for cars any vehicle that has been involved in an accident is listed for less than the same vehicle accident free. At least that’s my experience.

in Georgia,you are entitled to a cash payment equal to the diminished value of your vehicle...not sure about Texas......happened several years ago to me when guy hit my wifes car and was insured by Progressive....I had done some research on diminsihed value of wifes car and when their adjuster tried to tell me they would not pay diminished value, my reply was "you can send me a check for $1,200. or you can pay $1,200. plus my attorney's fees,your choice"....after approval from his supervisor,they sent me a check for $1,200.00.....this was in addition to them repairing my car at body shop of my choice and paying for a rent car while my car was being fixed..

Thanks. This was helpful. I looked it up and it seems Texas is a diminished value state as well. I’ll ask the insurance company about it.

Definitely fight for diminished value from other party's insurance. Get your agent involved if you need to. Maybe even a lawyer. Tell them your wife is going to see a chiropractor. Dont settle until you get what you feel is fair. Insurance companies count on a quick settlement. I had a truck totalled by a lady that ran a stop sign. Insurance company wanted a quick settlement to get me out of rental. I refused 3 of their offers before settling.
