I need some advice ! my mom past away last January. She had a will but the person she listed as executor was not able to be located, So I got in touch with the attorney she used to write the will . He mentioned doing a monument of title. Since everyone involved got along. I agreed and paid him the $1700 dollars to take care of it . We went to court the end of February. ( he had another attorney show up he was not able to make it), the judge was kinda Leary of how fast it was moving. We left with some paperwork and confused. And was told to set up appointment when we had everything settled.
My mom did not have any money , other than her house and mineral rights for land that she used to own .
Things have drug out because of red tape with transferring mineral rights .
Was not able to sell house at a fair price in the condition it was in .
Plus having problems with some of the paper work because one of the beneficiaries is a crack head .
The estate was left to 50% to me
25% to a nephew
25% to crack head nephew
Know one is fighting but One is dragging his feet.
I decided to fix the house up to sale it understanding that it was all on me .
Well I just got a letter from the Attorney that he was charging me $500 dollars for two more hours of work which I feel like he has not done a dam thing really.
I asked him what he had done to earn the extra money. He said he would send a invoice but it just says two hours .
I feel like I have to end this but don’t know what to do.

The system is set up for lawyers to make money.
It should not be hard to change title or transfer money as an heir.

Been down this road when my mom passed. My brother and I got along somewhat. I had to deal with the house while he was 300 miles away barking out orders. The attorney that mom used did the same thing (charged me 200$) for a phone call. Ultimately we ended up paying the attorney to assist in some of the decision making because we both knew it could end up ugly if we tried to do it ourselves. Took my wife and her sister nearly two years to finally settle their father's estate. And fortunately my wife had forced him to get his affairs in order and implement an estate plan (will, trust, POAs). Longest delay was getting a small fry oil company to transfer royalty interest to the estate. Now the wife and I are meeting with lawyers and getting flat rate prices for our estate documents.

That’s my problem is the gas companies,
Is it possible to close out the estate before royalties are transferred?

Don’t pay the 500. Attorneys seldom go after small amounts. They just Bill someone else. Much easier. 15 years ago my divorce lawyer wanted another 10k to keep things going.I fired her. She charged me 900. To file the papers to be fired. Her office was 3 blocks from the courthouse so she took a leisurely walk to hand papers to the clerk and charged me for her time. I then got a real lawyer. He also told me if someone doesn’t pay it is easier to keep working and bill someone who will. Sorry for your loss good luck. JD

I would PM Uncle Zeek one of the moderators who is an attorney. He might be able to give you some advice and get you going in a better direction.

Seriously, PLEASE PLEASE PLEASE get with a good attorney, spend the money, and get your estate wrapped up tightly so that your wife, kids, and other heirs do not have this mess. As this shows, you will pay a lawyer now or someone will pay a lawyer later (and guess which one will be more??!!).
