Several neighbors had their vehicles broken into recently. My next door neighbor had a pistol stolen. He is not absolutely sure he had the door locked but ordinarily would. Of course, he immediately reported it stolen. He is worried about his liability if the weapon is used in a crime, especially if someone is shot. He thinks he remembers someone who was held liable for damages done when a vehicle was stolen and wrecked.

What would his liability be and would homeowner's or vehicle insurance cover the liability?

pretty sure they would have to at least show reckless behavior that allowed the gun to be stolen in the first place.

doubt he has any liability for someones actions.

broke rule #1 imo, NEVER leave a gun in a vehicle unless you have a good pistol safe in it. chit happens!

This is a good reason to be afraid of firearms. Pehaps the person who stole it was just down on his luck and he needed it more than your neighbor. To answer your question, since he did the right thing and reported it stolen, there is no further liability to your neighbor.

I do but I don't leave them in my vehicle when I am not in it. My neighborhood is pretty quiet. Only crime I remember is someone stealing Ford spares.I guess they had a Ford lowering tool. Just went after unlocked spares and never went in to a vehicle.

Always a good idea to remove valuables from the car every time you park. Thieves aren't looking for change in the console.

Are you sure leaving a firearm in an unlocked vehicle would not be considered negligence? I'd sure think so if I was victimized by that gun. Leaving a gun in a car is irresponsible.

I disagree. That's exactly what crackheads are looking for. I had my window smashed in for about $4 worth of change in my ashtray, plus my electric shaver out of the console. They left a computer and $1000 set of golf clubs in the trunk, but didn't leave a penny in the ashtray.

Report it stolen and keep the paper work


call it what you will...he is not definitely not anywhere near the top of the list for QB's that I would choose needing a FG or touchdown drive late in the game.

You raise a great point, but the OP said his neighbors had vehicles "broken into". I think it would be hard to prove that his neighbor did NOT lock the vehicle door. There are ways to gain entry into a vehicle without smashing windows or door locks I think. If the doors are not locked to your home and someone comes in your home and grabs your gun off the counter are you negligent? I don't know, it seems to be outside the reasonable expectation of securing your gun.

I never leave my pistol in my truck. It comes in with me when I’m home for the night and sleeps pretty close to me, “just in case”.
