Oh, my blood pressure's fine. I just have a low tolerance for stupidity. Before I "matured" I handled stupidity as a matter of everyday life. But now I see that stupidity is taking over the country.

Some are tending to conflate two separate issues here.

The question at hand is application of the law that existed at the moment of the wreck. There are elements of any potential offense. The sole question is whether the facts work to prove each element beyond a reasonable doubt.

A separate issue, confusing some, is what they think the law should be. Perhaps a worthwhile discussion...but outside the initial question.

Bottom line, unless you are a Clinton, you have to live with the law as written.

Well back to the OP's original question. I think DUI is the appropriate charge. Some others make a good point that had the guy been sober he might have been able to prevent the accident, but we can't know that. Since we can't know, we have to stick with what we do know. The other car ran a red light and was a fault. This guy was intoxicated, but not at fault, hence the DUI charge is appropriate.

On a side note. Uber is cheap. DUI's are expensive. Ya'll just need to hang on a few more years and we'll have autonomous vehicles.

Wrong, seen too many accidents where it was flat unavoidable. Can't have two parties at fault in an accident
