I can't say why the boater didn't call the game warden to educate the dock owners and I don't know why the other law enforcement agencies did, acted or said what they said. I can't answer any of those questions, I was just giving a perspective on my experiences during my career. Sometimes when the law is enforced, the sentiment is that they were too harsh and when it's not enforced they're either lazy or stupid. The sentiment depends on who it's directly affecting. For the record, I'm not siding with the dock owners! I am just stating my opinion and mean no disrespect by this, but I don't believe the sentiment of how a law is enforced after the fact should ever factor into a decision in enforcing a law. Laws are not open for interpretation. Now the level of punishment can vary but just openly not enforcing a law because of how it may be perceived after the fact completely discredits the law itself.

As an LEO sometimes you just have to pick which battles you want to fight. I know what the law says and what should be done when you're dealing with people like the dock owners mentioned at the beginning of the thread but are you going to arrest those people for being a$$hats? Sure, you could but you'll never get a prosecuting agency to prosecute those dock owners for their behavior. They (prosecutors) don't want to expend scant resources on such cases. Case's in which they have a high probability of losing. I know I'm about to get flamed for what I wrote but I'm speaking from over 30 years experience of dealing with such people as those dock owners. Wrong you enforce the law...It is the DA's job to prosecute them if they chose to. My son is going into law enforcement ( going to be a game warden) like a lot of my family. That is why you call a game warden because they will take it seriously. Now does that mean they get arrested? Maybe be not but you will get their attention. Unless the officer (whichever branch) actually witnessed the act or has documentable proof (video or pics) then it is basically, he said - she said type of situation. Doesn't matter how you or they "feel", there has to be proof for the LEO to take action. I know it's some crazy thinking but there's a silly piece of paper that mentions due process.. However, it can escalate if it isn't addressed. Years ago, there a particular boat house on Chambers where the landowner would come unhinged if you were near his dock, much less fished it. This went on for awhile, with various incidents occurring until it reached a point that he'd stand on his porch and shoot at you with a shotgun. GW was called, a "sting" was quickly put into place and said landowner went to jail. Much to his surprise.... Good luck to your son in getting the GW job. Highly sought and few positions open every year but a very worthwhile job endeavour.

If the dock owner is never told by LE that he is in the wrong he will continue to harass people which could result in someone getting hurt. By not warning him of the law you the LE person is reinforcing his incorrect postion.

For the record, I'm not siding with the dock owners! I would have called if I was not in a tournament and time was not an issue. I have the GW hotline number in my phone. Like I said I kept my side of the conversation pleasant and attempted to educated them, which they were taking none. I would like to have a GW come fish with me and lets go fish around the dock, that is the sting that one should do when a situation like this comes up. GW dress in plain street clothes. I have fished that dock and area multiple times over the years and this is the first instance that has ever happened. They may be the new owners and don't know any better. She left and then came back out to write down my TX #'s, it was at that time I decided to take a pic of the swim area at which I had already moved back out and on to the next dock.

I drive by this dock almost everyday. I would think that a call to the GW would be a start. If everybody would call the game warden each time it happened I would bet the GW's would get tires and start writing tickets. I know Llano and Burnet County value sportsman and the $$$ spent due to the lakes. Most of the judges are sportsman so they may be a little more sympathetic. Either way The more complaints the receive the stronger the case would be.

Spoke with LCRA official a moment ago. He received several complaints on these folks from TFFers. He and Game Warden are going to speak with property owners. Buoy line will be taken down per LCRA rules and harassment of fisherman under the TPWD Navigation of Texas Streams code will be explained to them in detail. Good job guys!
