Seems to me that it could be argued that if the business was conceived and developed during the marriage, then the wife could be considered part owner. If it started in the garage, then jointly owned assets were used as a part of the business. Even if she wasn't directly involved in the business, she could argue that she contributed by cooking, cleaning and otherwise facilitating the man's time to chase the work.
Not saying that is fair, or right. Just saying that's how it could be argued by an attorney.

They each keep what they brought into the marriage. Everything earned after that is community property. Once they're divorced, she shouldn't be entitled to any of his future earnings, unless there is child support involved. Or alimony (not sure on Texas law here). I know several guys in Wisconsin that would be retired by the early 50's but who will be working well into their 60's. Pick your spouse wisely my friends! No alimony in Texas. It's called Spousal support here. But it goes both ways in Texas. One of my many (list growing) ex-daughter-n-laws tried to get it from my son. Judge based it off what he earned, and what she potentially could earn if she got off of her lazy tail and worked. Since she had a college degree and chose to not work, she was awarded nothing.

IMHO , I am not a lawyer , but pretty much negotiated my last divorce. She is entitled to half of side business income and assets, if it were acquired during the marriage . but no claims on future earnings. Does the side business have assets ? like inventory , supplies and equipment, working capital ? Is it a going concern with market value ? She could claim half of assets and market value, or possible force the sale of the business.
