I'm observing a case that is heartbreaking (it's not anyone from TFF or THF)

Parent dies without a will, and leaves multiple surviving children. During his/her lifetime, the parent verbally told the kids "I want to be cremated when I die". Now, half the kids are good with cremation, but the other half object to it and won't allow it to happen.

This is not a fight over money, property, who gets what, or anything like that - it should be a simple matter of respecting the deceased parent's final wishes, and instead is turning into a truly ugly family battle. Even if you have no property to pass on to your children, grandchildren, etc. (or you want everything donated to a charity), you should still have a will that spells out any final wishes you may have - even something as simple as "I want to be cremated", or "I want a photo of my family to be placed in my hands in the casket".

In our preplanning we were told by a mortician that even with a will if any children object to cremation it can't be done. We questioned all of ours to see if they objected before proceeding.

We didn't check with a lawyer because they all agreed to our wishes so it wasn't necessary.

Did a $99 will through legal zoom. Covered all the bases but the one your referring too (I think) even the living will. Need to look it up. I'm not an old but close.

Brought this up in a discussion and an interesting solution was proposed.

In the will and in their burial directions it was stipulated that if any family member protested their burial wishes then the protestors would have to pay for any additional costs incurred due to changing their plans including plot purchase.
