Game Warden checked me and wife on Toledo last Thursday and my Onyx was sitting on the floor of the boat. GW informed me about it, explained the law to me and let us go. Now I will only wear it if alone. Using the "old" style from now on.

A lot of game wardens get this wrong. It has to be worn at all times if it is a Type V. Some are, some aren't. It's easiest just to carry a spare. THIS^^^^^^

Does that mean you need to carry a non-inflatable life jacket AND a throw cushion?
I wear an inflatable (not sure what class) all the time, but I fish alone almost always. I carry a throwable cushion back by the battery, but no other wearable PFD. Do I need to get one even though I have the cushion?

Do I need to get one even though I have the cushion? Educate yourself on the class of the inflatable. It is always a good idea to carry a standard PFD in the boat "in case". In addition to your needs if you take a dip and the inflatable inflates, you'll also be OK if you hook up on the lake...

I know a guy that fishes by himself in La, and got a ticket for not having a throw cushion in his boat. He told the game wardens if I fall out who is gonna throw it to me??? Didnt matter, $300 ticket. HaHa I see no reason to require an adult to have to have a life jacket in a boat. I am sure the Life Jacket Manufacture lobby for that to be a law. Having to wear a seatbelt in a car is another stupid law

This is simply not knowing the laws. All inflatables are not the same. It's all based on the Coast Guard rating of Type I, II, III, IV or V. Most of the original inflatables were Type V's but that has changed a lot now. As long as your inflatable is a Type I, II or III, it's legal without having to be worn. the law should just state that if the big motor is running, you should be wearing a life jacket. when it's not, you can wear it or not.
on a side note, i fish by myself some, but i'm going to retire soon so my fishing alone time will increase. i want to get one of the auto inflate devices to wear all the time. i am concerned about how hot they would be; any recommendations on the best for comfort?

Tin Man, when I fish by myself, I wear a Sterns inflatable belt all the time. It cost $90 and does not get in the way. When I get ready to run, I put on the real thing. Just say'n.

Or we could be trying to help those who have gotten a ticket, or those who might get stopped to have a polite conversation with the GW and tell them they are aware of this issue and have been researching it. You'd be surprised how many cops actually listen when you don't act like a jerk to them. And for those of you who care, it's actually in a federal law that TPWD has adopted for maritime purposes. There is no actual state law on the topic. According to TPWD website - https://tpwd.texas.gov/fishboat/boat/safety/vessel_requirements/"Inflatable PFDs are authorized only when used in accordance with requirements as presented on U.S. Coast Guard approval labels. Inflatable PFDs are not approved for use on personal watercraft, waterskiing, or other high speed activity." So as long as your inflatable is a Type II or III you do not have to wear it all times. Make sure you keep your tags on your vests that show the rating though. The last line of the paragraph is what eliminates ALL inflatable PFDs from being stand alone legs. A power boat of any kind operates at high speeds. They are perfectly legal as as a stand alone PfD in a kayak, canoe or manually powered boat. Also all of the posts on here arguing that the law doesnt say that can argue with a game warden all they want to and when you do I can assure you that a ticket will be given. If you play dumb and say you will make sure you have a pfd next time you might get a warning. So argue all you want but save it for the judge. You wont win but you can feel smarter. Yes, but sitting in a boat fishing is not a high speed activity (for most of us anyways). No one was saying to argue with the game warden, I was just educating the topic because you certainly can argue TO the judge and prove you were within the law. But hey, if you prefer to take the ticket and pay the fine (because the video stated they weren't giving warnings), then the community can thank you for your donation. Really you are sitting in a boat with a 250 HP motor on it and you think that because you arent running the big motor the warden shouldnt give you a ticket. Come on out and Ill let the warden know your coming so you can argue with the judge. We can see how that will turn out. Some of you arm chair lawyers should give it a try maybe after the judge tells you to pay your fine and get within the law you can sue the state and TPWD to prove your right. Heck take it to the Supreme Court. Or just buy a life vest and keep it in a storage locker.

I would personally like to thank the govt for babysitting us. They wouldn't have to if people were smart enough to take care of themselves and when they don't they want to sue somebody for not telling them. Crying about a life jacket law is ridiculous. NOBODY says you have to wear one, they just want to make sure if you do that it will be the right one to save your @$$.
