Hmm? I am not an attorney and things, too, could be different in Georgia, but I am very surprised they didn't detain the man who answered the door having a "probable cause." If nothing else, that would have ensured that he, in fact, wasn't an intruder or that other people who may have been in the home weren't in danger. What if the dude was having some sort of psychotic event?

But, there is a bright spot in the article: The fishermen did exactly what they should have done, yelled out they were leaving, get the heck out of there, call law enforcement.

Too many times, someone (in the right) stands their ground and ends up paying for it . . . permanently. A good lesson to share with your kids.

I know a lot of people in Texas carry on the lake and the guy who did the shooting might have gotten shot if here in Texas. When in fear of your life you are legally okay to shot back. These people are lucky he was either a bad shot or was just scaring them either way it's a good way for someone do die.

If you ever get to meet Gary Klein ask him about the time he got shot at. I believe it was in the Louisiana Delta maybe 15 years ago. Guy didn't like that he was in some slough that he thought was "his" and shot above Gary with a shot gun. I don't think they ever pressed charges on the guy.

The Kikgore Bass Club president and his brother had a lady pull a shotgun and shoot over their heads on Palestine. I am not sure on the whole story, but I believe one of them got hung up on the dock and they were going get the lure. I know they were shaken up at weigh in.
I stayed north all day. Lol

Boat doesn't offer much cover or concealment even if your packing best bet is to just get the heck out of there.

Fishing in LA over by lake catouche(or however you spell it) the summer before the classic was there we were fishing by a neighborhood that's out on the water. It wasn't unusual to hear shots and some guy sounded like he was shooting a .22. We fished down the bank a few and before we knew we could hear the wizz of bullets flying by. Kind of stupidly we just looked for the guy and kept fishing. I'm still not sure if he just wasn't paying attention or didn't want us there.
Back when I was a kid we used to ride four wheelers at an old lumber track. There was only one way in and one way out. Well that way went buy one of my friends crazy uncles house. You either all went at the same time and never let up or you had to space it out so he would put the gun up in between runs. There were quite a few shots at us over that place.

You don't want people fishing around or near you...STAY THE HELL AWAY FROM LIVING ON OR NEAR THE DAMN LAKE. Simple...but then again, you can't fix stupid.

Well, even in Texas, and even if you are packing, don't ever shoot back if you have any possible exit routes. You have to drop that pretense almost all Texans have of standing your ground and do what they tell martial art students to do when someone picks a fight: if you possibly can, avoid the altercation.

And, it gets very difficult to prove who shot first if someone returns fire. That doctor might wish he'd taken some return fire. If he is a big wig and is well-wired in his community, eats lunch with the D.A. and judges and so forth, the fellow in a boat might be the one in deep trouble.

As it is, without reading anything about it, I hope they elect to prosecute him. A big giant fine, loss of his firearm's license and community service seems about right to me.

I think the man in the boat handled it perfectly.

Nothing criminally will come of it. They couldn't identify who it was and he lawyered up and knows not to talk.

I did read the fisherman now states that it has effected him psychologically and made fishing unpleasant. It sounds like he may be going after the doctor where it will really hurt, his check book.

Yes, a civil case instead of a criminal one. You may recall that while O.J. Simpson was found innocent in his murder trial, he lost the civil case where juror unanimity isn't required.

Just a guess: it'll get settled out of court. The affected fisherman will feel better with his new boat and gear.
