Take a look at pictures of Sharpshinned and Coopers hawks. Both are pretty common around houses in the winter, especially if there is a bird feeder nearby. They feed on birds that they pick off of feeders.

Looks a little dark for a red-tailed. My guess is a Coopers hawk. We had one munching on a dove in our backyard a couple of years ago. Beautiful birds!

It's a Red-Tailed Hawk.
The bone structure of it's head and the robust build of it's body immediately place it in the buteo family of raptors. This eliminates, eagles(bald, golden), falcons(Kestrel, Merlin, Prairie, Peregrine), and accipiters(Goshawk, Cooper's, Sharp-shinned).
That leaves leaves a few possibilities considering the mild winter and Texas' location along raptor migratory routes this leaves Swanson's, Red-shouldered, Red-tailed, Broad Winged, Rough-legged and a few others that are much less common. Of these only the Red-Tailed fits the bill for coloration and morphology.

I'm no expert on raptors by any means, and some of you sound like you are.
However, that is a juvenile Cooper's Hawk 110%. I can't post photos or I would attach one that is nearly identical to the one above. The coloration is completely wrong for a red-tail at any age. Further, look at the handrail the bird is perched upon. It's 4" wide I presume. Now compare the bird's stature to the handrail.
It's a Cooper's

The bird in his photo has brown eyes. The cooper's hawk is an accipiter which do not have brown eyes... All accipiters have bright yellow eyes which darken to a blood red with age.

It's a Cooper's Wrong. Eye color. If it's not yellow, orange or red then it's not a Cooper's. Brown eyes are a sure sign it's a red-tailed. Bone structure in the head is also that of a hawk not an accipiter. The bird he took photos of has a very regal head where as Cooper's have this crazy scatter-brained looking head.
