No. And as long as it is a rifle or shotgun you can ship it direct to the buyer if you both live in the state of texas.

You may not get caught, but I'm pretty sure the law says you have to ship to an FFL, whether you're in state or not. I never understood this rule, because you can sell face-to-face without getting an FFL involved. But I do believe you have to go through an FFL if it isn't a face-to-face transaction, regardless of whether it's an in-state or out-of-state shipment. I could be wrong, but that was always my understanding.

No I'm not wrong I have an FFL and can assure you that if you are buying or selling an unrestricted shotgun or rifle from an individual you can legally ship it door to door if it doesn't cross a state line. This does not apply new guns or used guns sold by an FFL holder. This also does not apply to handguns which must go through an FFL holder.
Believe it or not this has been the law since 1984.

Actually, you CAN ship a handgun by common or contract carrier, to a person in your own state. Just not USPS. Here is the direct quote from the ATF's FAQ on the subject.

Q: May a nonlicensee ship a firearm by common or contract carrier?
A nonlicensee may ship a firearm by a common or contract carrier to a resident of his or her own State or to a licensee in any State. A common or contract carrier must be used to ship a handgun. In addition, Federal law requires that the carrier be notified that the shipment contains a firearm and prohibits common or contract carriers from requiring or causing any label to be placed on any package indicating that it contains a firearm.

[18 U.S.C. 922(a)(2)(A), 922(a) (3), 922(a)(5) and 922(e), 27 CFR 478.31 and 478.30]

Please don't read this FAC as being OK to ship a handgun to an individual. The question on this FAC was if a non FFL could ship a gun common carrier which was answered. But if you are shipping a handgun it MUST go to an FFL. The answer and law is very clear. If I get time next week I will post the rule from the office.
Also just for general info an idividual can also ship a gun for repair directly back to a manufacturer or authorized service center, but the gun cannot be shipped directly back to the individual it has to go through an FFL upon return.

It does answer it. It says to a resident of his own state, or a licensee in any state.

Actually it only tells how a non FFL can ship a gun and doesn't go into the issue of handgun.
I will not argue about it. I will warn anyone reading this to not ship a handgun to an individual as it is against federal law.

If you must know why don't you send the ATF the exact question can an individual ship a hand gun directly t another individual.
