When you fish in Mexican waters and are checked by the Border Patrol upon returning, must you have a pass port?

No. As long as you don't get out of your boat and touch Mexican land, you have not technically been in Mexico, so no worries on going across. Now, if you do get on Mexican land, and then return to Texas, I believe that you can be cited/ arrested/ something for illegal border crossing (i.e., not via an actual CBP bridge)

Too bad they only enforce that on American Citizen or Legal Permanent Residence

Well, you know what I mean. No need to swipe your passport, no reason to have to declare anything, pay any tariffs, etc. Either way, if you don't get out of your boat on Mexican land, you are not on Mexican soil, so there is no need for a passport.

When you cross over in Mexico, don't get off your boat and on land. Don't talk to the Mexicans and you will be okay.

Texas DPS actually just bought some boats like this and has troopers in San Diego being trained by the Navy SWCC guys right now. A trooper friend of mine was just telling me about it. Google Texas DPS boats and you'll see the stories.
