fish on privately owned waters, fish in public water from private land, or hunt on privately owned lands without the permission of the owner or the owner's agent. Under the Texas Penal Code (§30.05) it is an offense for any person to enter property that is fenced, posted with a sign(s), or marked (purple paint) without the express permission of the owner. Posts or trees bearing purple paint marking of not less than eight inches in length and not less than one inch in width at not less than three or more than five feet from the ground constitute notice that the property is posted.

That’s new to me. Just wondering why you posted this, did you have a run in with a land owner or a trespasser?

purple paint- no trespassing. common law in every state I've ever been in ( 'cept Tx.) you gotta be pretty country to know that one, though..... G-dub's honor it everywhere I've ever been, incl. Texas!

100 per cent right on the money. Not very many people know that at all. If you do a lot of bank fishing I would strongly suggest to be updated on the Texas penal code-Criminal trespass laws.

If you do any hunting, they mention this in the hunter's education course. If I didn't hunt, I probably wouldn't know about this. I think they should make this more common knowledge some how.

I never knew the purple paint bit, but its just common sense that if something is fenced, its private property and you need to ask permission. If it looks private, it probably is.

In Texas the way the law reads, a purple marker can mark any property - it doesn't have to be a fence line and it doesn't have to be rural. It also doesn't have to be illuminated.
I have a purple stake that meets the height and size requirements in my front flower bed and one at the back of the house. It doesn't detract from the appearance of the house like a big No Trespassing sign would but it means the same thing.
It's just a little added weight to my side of any situation that might arise.

yes its a unfamiliar law, i agree, but my dad made sure i understood what the purple markings were when i was a kid. Because where i grew up the land owners had a shoot first ask questions mentality.
