This has come up before, but I'm not sure about Ray Roberts. I was fishing the docks in the marina, specifically the ones closest to the Sanger Ramp. by the pontoon rentals and the gas dock. I passed a couple of peaces of styrofoam block floating between the dock and the bank, but didn't think anything about it. A dock employee saw me behind the styrofoam and said "you can't fish in here, you need to leave. I said. " you can't restrict where I go on public water." He told me something about there being a cable that was down that normally blocks the access, and how the styrofoam was supposed to be a boundary that was not to be crossed yada yada. He said something about OSHA being concern about fishing line in the gas hoses.... I just smiled and said, "no problem, I was just leaving anyway." I wasn't to bent on fishing in there anyway, I was just waiting for my son to come out to the lake for a boat ride. I really felt like the guy had good intentions after the chat, and was just relaying what his boss told him to say to fishermen. Has anyone heard of fishing restriction around gas lines?

This is something that seems to vary. Some lakes have the law others don't. There doesn't seem to be a "blanket" law on the subject.

Unless the State/ TP&W or Corps Of Engineers posts an area off limits it is Illegal for Anyone to block access to Navigable Waters.

No City Ordinance can supercede State or Federal regulations.. Period.

This law does not apply to private lakes.

You can fish anywhere around the marina State law allows and he feed you a line of BS. OSHA has no authority over fish and game. I would have told him please call the Sheriff and ther local Game warden. Even on Lakes that are controlled by the River authorities the water is still public water and all state laws apply. In the State of Texas the Corp nor the River authoities can restrict water without approval from the TP&W. Now If they put up a cable up to block your access well you are probably out of luck because they will have a so called other reason for it. They always try to say it is to control theft. Theft of [private property that is sitting on public property is not the publics responsibility to control and the publics rights should no be in fringed to protect the private intrest of the few. Those few should protect their own property by building a more secure structure. With doors and or lock [censored] up might help.

I have now had an incident 3 times at Lewisville with marina owners. I don't really care, but they try to call the game warden and take down my tx numbers..I gladly ignore them and continue down the row.

State law allows the "Owner" of a lake to resrict access for any reason they see fit.

If it is a no fishing restriction than ALL fishing is prohibited. That is why the two marinas at Ray Hubbard cannt enforce the city of Dallas Ordinances, because they allow people to fish from their boat slips and in the fish house.

Well today a guy asked me not to fish in his slip...So I kindly obliged, and skipped his slip, and then fished the next one. I don't know if he thought I was trying to be a smartass or what, but he flipped out and told me I had no respect for other people's property. He made no sense because he told me that fisherman have casted and ruined their propshaft with fishing line wrapping around it, even though it the boats are backed into the slips.. I don't know how to make a wrap around cast! But he walked out to the end of the dock to get my tx numbers, and I told him he didn't need to walk any further and I would gladly read them off to him...It was kind of funny and it is the third time I have been pestered on lewisville alone..The other one was worse, some lady called the cops on me because I fished her slip and tried to tell me it was private water and I couldn't fish it unless I had a slip in the marina. She kept telling me to leave the marina, and I told her that I was working my way out...She raised he voice and I got irrated so I just turned around and gladly worked her slip again!

Mep2too,
First who told you that State Laws says the owner can do what they want?
Second who do you think owns the Lake?
Third can you post up a copy of the Law because Texas Parks and Wildlife might want to see it. Because right now they and the Attorney Generals office both say Public water is Public water?

Because if you did not know all water in a Navigable water way belongs to the State and is controlled by the State. The Water Authorities have to get permits to use the water and do not own the water.

If a lake is public water, the public has the right to boat the entire lake, and to fish from a boat (subject to regulation by government entities).31 A person who interferes with a lawful boater may be committing the crime of obstructing a waterway and/or harassment. Both are Class B misdemeanors.32 By the same token, a boater who unreasonably obstructs access to or from a dock or boat slip may be guilty of obstructing a waterway.
