Where do you see it was a drunk driver? They have no evidence as of yet. Family believes he may have had a diabetic episode according to the article.

Either way, prayers to the family. The article was updated at 1:27. It originally said the driver was suspected to have been drinking. The family said the driver was diabetic and they updated the story. Diabetics that dont manage their blood sugar properly can appear drunk. I have a family friend that used to manage his blood sugar by taking insulin without checking his sugar level, not eating anything after taking insulin, and would have low blood sugar episodes where I would have sworn he was hammered.

I'm making alot of inferences from that statement. One thing it tells me is that the driver has had enough 'diabetic episodes' that his family recognizes when one happens. It also tells me that the driver was well aware of his (her?) medical problems that made it unsafe to be driving.
If you've never previously experienced a diabetic episode, fainting spell, etc, you have no reason to believe that it's unsafe to be driving. But once you've had incidents and/or diagnoses, then you KNOW that you're a risk to other people on the road and shouldn't be driving.
A claim against the driver for gross negligence or recklessness might be appropriate.
