Funny. The HOA I lived in Dallas a while back would fine you if you left your garage door open during a specified time period.

The news organization is stupid for quoting a nine year old as the first resident quoted in the story, as the nine year old neither owns the home nor is a member of the HOA.

While the news organization may be stupid for quoting a nine year old and you are correct that he is neither a owner or HOA member it does show that he has more common sense than the HOA board members by his statement.

This may be from the land of nuts, fruits, and flakes however it has happened in Texas. 3 attorneys in my family and they have all fought (and won) against HOA's. Most were pro bono and were not class action in nature. HOA = Housewives Overly Anxious

I wouldnt count on taking the HOA on in court if you signed the agreement. People are usually surprised at what they signed up for and just how much power the HOA has in a dispute.

As this may be in CA HOA's in the state of TX have just as much power and can foreclose on your house in 60 days if they know the law. Right now down in the Katy area a HOA is trying to make a former Marine take down the Marine Corps flag. In 2015 after the police shootings in Dallas over ia HOA in the Ft. Worth area made a home owner take down a Blue Line flag. The HOA's will win because in a HOA there are only two flags that can be flown legally in the state of TX and that is the United States and Texas flag. This law was put in place four to six years ago because HOA's were forcing people to take down these flags.

If it werent for the HOA I live in, this place would be full of pastel houses, cars on blocks, railroads ties, and other what not. Your idea of a boat in the driveway is not the same as others boat in the driveway. For example:about 15 houses down from me someone landscaped with plastic plants.

Worked for a company that had a plant in Riverside Ca.. We had an employee living in the plant for 2 months. When production stopped for the day he would go across the street and get dinner. He got caught when they found his sleeping area and because of the path and hole in the fence.

I lived in a HOA for my last 15 years or so in Dallas and credit them with keeping the home values in my neighborhood high and made my house much easier to sell. Down here in East Texas there is not really a need for one, but if I had to move back to Dallas, I would look in a HOA. Most of the restrictions in my HOA were common sense measures that most people followed anyway.

We have an HOA that does a good job at keeping up the neighborhood. And just to be clear, an HOA cannot foreclose/take your house in any way. That was signed into law years ago. If you're not up to date on your HOA dues you can't sell your house until all back dues are paid in full. I don't know how they can stop that but they (HOA) seem to have a lot of pull.

I've seen plenty of homes being auctioned on the Denton County Sheriffs sales that were foreclosed for HOA assessments.

I wont buy anything with any restrictions, Im not looking to start a pig farm but dang sure are not going to let anyone tell me I cant or that I need to mow. it already drives me nuts that Im technically just renting it from the gooberment , so lets not add insult to injury. This is false all the way around!!!! I know this as fact as my HOA filed foreclosure papers on me this last year. I had a meeting with them and read the law to them as how they can foreclose on a house in the state of TX and they said that would be a question for their lawyer. So my lawyer answered the court citing the state law and the next thing you know the HOA decided that they would not foreclose and told their lawyer not to show on the court date. When I get home I will cite the law for you but if you think a HOA can't foreclose on a home you are sadly mistaken and they can do it in as little as 60 days.

We are not through with my HOA at this time and my lawyer has told me that we need to now request that all leins be removed.

In the state of TX the only way that an HOA can foreclose on a home is if the dues are not paid. They can not foreclose on a home for fines, lawyer fees, or anything to do with such. However, the state of TX does not state that monies paid for dues have to be applied to dues the HOA can apply said dues to any fines and then your dues are not paid and they can foreclose. Like I said I will cite said TX property law later tonight.

Also if 10% of the home owners sign a petition requesting that a vote be taken to remove the HOA's ability to foreclose this has to be done as well. This is another state law.

Where in the world do you live where everyone wants to paint their houses pastel colors and keep junk cars on blocks? I can think of a few neighborhoods here in WF that are HOA's and for the most part, they really aren't that much different from the non HOA area's. In fact, I'd surmise, alot of it that's non HOA is nicer than what is.

I live on a lake property that has a HOA. The property was subdivided in the early 70's and had restrictions that are now pretty outdated. Nevertheless, the HOA primarily deals with maintaining streets, keeping trees in street ROW trimmed, maintaining park, swimming pool and boat ramp, etc. And they will make sure all of the set backs and septic tank county rules are implemented when building a new structure. Dues are very reasonable (less than a $100/year), and most of the work is done with volunteers. They will put a lein on property if the dues are not paid and usually they will collect 4 years of deliquent dues when a property is sold.

I would hate to live in any subdivision, not incorporated, that did not have a HOA. Too bad it is necessary, but unfortunately in the world we live in today, it is essential if you want to keep any semblance of decency.

This bunk that HOA'a help keep property values up is just bunk. The value of my house went up due to the market and the county appraisal nothing else. a couple of years ago when the value went down and I still had an HOA was this because they weren't doing anything no it was because the housing market crashed. Cities love HOA because it puts another person in line to inforce codes that can be stricter than the city has and the HOA's have more power to inforce them.

It's just crazy when the state has to write laws that says a Home owner has the right to fly the US flag, TX flag or put religious items on their door. These are just two laws that were written in the past four to six years due to HOA's. Former Senator John Carona owns a HOA management company and did $500 million in the year of 2015 and you wonder why the laws are in favor of the HOA's.

We have a community pool and splash park in my HOA and on the splash park there is a $14,000 Lein on it because the builder didn't pay one of the contractors and the HOA board is doing nothing about that. However they fine a home owner for having grass in there flower beds or painting a door orange without getting approval. I live in a nice neighborhood in Rockwall but the board is a bunch of idiots!
