Recently I visited a local Marina and saw an aquarium (hidden from the public) with a couple of baby Tarpon in it, say a foot or so long. Is this legal?

Thought about it & did some reading. If I had to argue for the person with the aquarium, it would probably be over the definition of "possession". Fish are not in "possession" at someone's home. I suppose the marina owner could claim that the place is his home. Maybe.

But in order to get the undersize tarpon to that 'home', he'd still have to possess them between time of catch and transportation to the aquarium. I suppose it might be possible to get a permit to keep such fish in an aquarium setting, but in that case, wouldn't the owner display the fish publicly?

*edit* On further reflection, maybe you can argue that an aquarium can count as a private pond.

Yes, I'm trying to be devil's advocate trying to think of ways that this could be legal.
