out at joe pool there is a rockbank levee at lynn creek marina that used to be 100% fishable by boat. over the yesrs the marina has put their boatslips closer and closer to the levee making it nearly impossible to get a 20ft boat around the backside without tearing your boat up. now they have taken it a step further and placed a rope with a white dock bumper across from the levee to their dock making it totally unfishable by boat on that entire side. is this legal or illegal on their part?

Just tie on to the dock with your boat and pull it out a few feet. Show them you are not playing there games.
And one day you will look back at this post and realize just what the hell was I thinking.

They have cables there now also that are anchoring those boat slips. You won't be able to get back there anymore. They did that after the flooding last summer.

I was out there last week and started to go between the levee and the dock, slipping over a submerged cable. The guy in charge of the construction said to the guy next to him, "I wish they wouldn't go back there." I was already backing out anyway and went around and fished the slips on the other side. While we were over there, we saw the other construction guy bringing over another cable and stringing it above the water level to prevent other boaters from going back there. Not sure what their issue is, if it's a liability concern or they just don't like fishermen fishing in their marina.

I think it has something to do with the rising water tearing up those boat slips and boats. Locking fisherman out of an area is just a plus for them.

Would probably have to check the lease with the Army Corps, but I expect that they are within their rights to "protect" the boat docks by stabilizing them with the cables.

It is a wind break from the Main lake for the marina/boat slips.

From what I have read it is not legal. In fact it appears they may be guilty of obstructing a waterway

Q: Can a marina operator or lakeside landowner keep boaters away from his
docks?
A: Not on public water. If a lake is public water, the public has the right to boat the entire lake, and to fish from a boat (subject to regulation by government entities).31 A person who interferes with a lawful boater may be committing the crime of obstructing a waterway and/or harassment. Both are Class B misdemeanors.32 By the same token, a boater who unreasonably obstructs access to or from a dock or boat slip may be guilty of obstructing a waterway.

I really don't think they are putting cables in to restrict boats from fishing a small area. This has more to do with locking down the boat docks, I wouldn't be surprised if the lake authority isn't supporting this because it reduces potential debris going into the lake if we have another record flood like last year. I think they are doing something similar at the state park boat slip area also with the cables.
