Hi I really really don't want to get into any specifics but game warden pulled up the other night and banged into the side of my boat about 7 or 8 times looked all through it took my license and wrote me a ticket for fishing without a fishing license in my pocket I do have the last three years fishing licenses in a little pile with the ticket and I would like to take them up there and explain my side of the story but I know I'm just going to get screwed so I just wanted to know when I need to go pay this stupid thing off how long do they wait before they turn in the ticket?

Also has anybody ever had a weird encounter with the game warden and supposedly got a ticket but they never turned it in?

Im guessing you didn't have a current fishing license at all,or you have one but it was not with you? You should have a court date on the ticket if your going to contest it.

So you've got a license, but he took it and wrote you a ticket for not having a license? I would think you're previous years license would be irrelevant. If you do have a license, but didn't have it on your vessel or your person, you could probably get it dismissed. I was hunting and had to go use the bathroom, my wallet fell out where I did my busines. Game warden pulled up and wrote me a ticket but I was able to get it dismissed.

What's your side of the story? Did you have a license, just not on you? Were you good for the preceding three years, just not right now?

First off, due to punctuation, there are several ways to interpret your dilemna. If you had (have) a current license, most will dismiss after showing proof. There may be a smaller penalty though for not having it on you. Most are understanding though. However, if you simply failed to get one, then what do you think would be the normal case here? If you forgot this far into the year after the normal August 31st one, you can guess you got a fine coming.

One time we were out on Limestone, and set two "Planter" trotlines out on the far side of the bottom of the lake. I knew one of the Game Wardens that came to the public ramp on that side by way of a P/U. We had headec over to use the restrooms. He normally checks our licenses once a year to make sure we are up to date. However, my daughter reached into her back pocket & it was not there. It had been there before we left, so the only thing she could think was it came out before hopping out of the camper. He looked at her & knew I was a stickler for playing by the rules, so he told her he did not actually see her fishing, but to get it back in her pocket once we returned.

I'm thinking we don't have the "rest of the story". TP&W site that says you must have the license on your person. I would interpret that to mean in your pocket.
Expired licenses are irrelevant and prove nothing except that you fished legal during those years..
As far as "turning it in", you can be assured that it will be and there is a date on the citation with a date by which you have to appear in court, if you want to contest it. If you don't appear, they will issue an arrest warrant just as they would for any type of citation.
Compliance is always the best policy. Game Wardens look at everyone as though they were a criminal.

Make a copy of the license, call the judge's admin or what ever they call them, send her the copy, call back in a few days, it will be dismissed. Don't make more of this than needs to be.

I once received a citation for fishing without a license. My valid license was sitting in another tackle box at home at the time.

I made a photocopy of the current, valid license, and mailed it to the court with a copy of the citation and a VERY short explanatory note. Ticket dismissed.

If you were just fishing without having a current, valid license at all (whether in your possession or not), you may as well just pay the fine and take it as a life lesson.

depending when this happen, and if u do not have a license, I would go get one now. been told of friends that not have a license, get a ticket, then go get license, they gave less of a fine for them. your ticket should say who to get a hold of too, what judge. it not the end of the world. good luck with it.

Why would a license with a purchase date later than the date of the citation have any bearing on the outcome of the ticket? That only means you did the right thing after you got caught. No valor there.. Fishing with no license is fishing with no license, period..

Game wardens can verify on spot if you have a current license or not if they choose to do so. Not sure what the issue is here

How old was your daughter when you were checked. Under 17, she wasn't even required to have a license. I'm wondering how many game wardens there are out there that don't know the laws they are trying to enforce.

It's funny, I read Lynn's post, and from the context, I assumed that his daughter was old enough to need a fishing license. Why bother having one otherwise?
