I don't know if your insurance advising you is the best action.
My wife got hit by a 18 wheeler on the Lake Lewisville bridge. Our State Farm insurance agent advised us to claim on our insurance. Then they would pay us and go after him and his insurance company.
He didn't bother to tell us that this would show up on our insurance as a claim against them and then they jacked up my rates sky high and I can't switch to another insurance company now because they want even higher rates for coverage because of my claim on my insurance. So I've been stuck paying high rates for years because of this...

My State Farm agent is a snake in the grass in my opinion..

I'm sorry this happened to you!!! There are definitely people on Lake Lewisville that have no business operating any kind of boat...

if parks and wildlife and local law enforcement made a report you should press the da to file class b misdemeanor charges for wreckless operation and excessive speed of a water craft.
my son and a friend were out on his friends jet skis and the friend turned in front of my son. they collided. no alcohol envolved. son gets warrant in mail Christmas eve. screwy deal. same should apply between a sail boat and motorcraft between strangers. did they have to blow? they were maybe intoxicated?

Reporting a Boating Accident

When involved in a boating accident, the operator is required by Section 31.104 of the Parks and Wildlife Code to:

Render to other persons affected such assistance, as may be practicable and necessary in order to save them from or minimize any danger.
Give his name, address, and identification of his vessel in writing to any person injured and to the owner of any property damaged in the collision, accident, or other casualty.
Also according to Section 31.105 the accident must be reported to the department on or before the expiration of 30 days after the incident. The report should include a full description of the collision, accident, or casualty in accordance with regulations established by the department.

It is the responsibility of each boat operator who is involved in an accident to contact TPWD or your nearest law enforcement agency if the accident:

Results in death; (within 48 hours) or
Injuries to a person requiring medical treatment beyond first aid; or
Causes damage to vessel(s) or property in excess of $2000.00
To report an accident contact your local game warden, local law enforcement agency, or call TPWD 24 hour police communications operator at (512) 389-4848.

If you have insurance call them, they have many lawyers, let them deal with it that what you pay insurance for.

If no insurance then you are probably screwed, If you get a judgement he will never pay and not much the law can do to force him to pay.

I would file a report with your local police and TPWD as well.

Your insurance company will pay for the damages to your boat then subrogate against the guy that hit you. Let them deal with it. They do this every day.

getting a lawyer will only cost you more money. That's great if he has money to recover. However, if he lied to you about the ins policy that tells me he doesn't have any money. I would just file a claim with my boat ins company and let them deal with it. This is what I have ins for. Don't waste your time, don't get bent out of shape on this. Life is to short. Get your boat fixed as fast as you can with as little money out of your pocket as possible and get back out fishing. I would file a small claims court case against him for any out of pocket expenses. He will prob come up with that money. If not, I would have a judgment on his boat.

Keep a good file with all the details. If he has provided any written information to you indicating he is at fault, that's the key piece. Get copies of the GW report.
I would think if you file on your insurance, you're obviously out your deductible. I doubt your insurance company will "go after" him. They will simply work the claim and then probably jack your rates up to recover.
Small Claims courts in Texas will let you seek damages up to $10K.

Sorry for your situation, obviously messed up the next several months for you.

Actually, if you use your insurance, they will probably pay you, go after his insurance AND JACK YOUR RATES UP..
