TPWD has a pretty weak website, but from what I was able to find on different pages, they state gear tags must be attached within a certain distance of a "free floating device". That would indicate that the device is a jug, noodle, etc. It also states that the devices can not be attached to anything, such as a structure thus creating a free floating device. I could not find anything referring to weights used at the end of the line. Everyone I have ever know who jug fished used weights to anchor it in place.
I'm betting that if you ask three game wardens, you'll get three different answers.

Just got off the phone with a Game Warden in Austin and he said that ether way is fine free floating or with a weight on the bottom. But be sure you got your name and date adress or phonne # Or both. Remember redate every 10 days
