I have signed titles for a boat/motor/trailer but the 2nd and 3rd owners never did any paperwork. So the boat has gone through 2 new owners without any paperwork, and the only bill of sale I have is from owner 1 to 2 and from 3 to me.

The titles are in the original owners name with signatures, no buyer name added. The owners original bill of sale has owner #2's name. I now see PWD 143 requires owner 1's signature.

Do I have to track down Owner 1? I thought a signed title was all you needed.

You will have to get original seller to sign. As TP&W say, do not buy a boat or motor without a clear title.

In Texas Titles are a waste of time!!!! I think that a signed title should be all that is needed but TPWD want this and that in addition, wonder what they will required next??

Sucks...you'll have to find owner #1. PWD 143 is for tax collection purposes, the most important part (to the state) of any transaction. You also might need a PWD 504 if boat is from out of state.

I've heard of "bonded" titles, but don't know anything about them, except they sound expensive and difficult. Not even sure one can be done on a boat? Anyway, best of luck.

Yep, sounds like a bonded title is the way you'll be forced to go if you can't get the paperwork straightened out. Not sure how that will work being an out of state boat though. There is some info on bonded titles on TPWD website, but I have never had to go that route with a boat. I know with a car it's not a huge issue to get a bonded title. Costs about $200 and some running paperwork back and forth from the title company to the tax office. Something tells me that TPWD will have found a way to make that more difficult and more expensive though.

Located owner #1, but before I contact them, what exactly do I need from them?

I have the signed titles, nothing needs to be done there.
Bill of sale mismatch (Owner #1 > Me required)
A signature on a TPW form

Should I call the previous owner and say something like "The previous owner never registered the boat, will you sign this TPW form and create a new bill of sale with me?" and provide documentation that I do in fact hold the titles and boat?

Follow Up: Can I use this boat before transferring registration? Tags are good til 2017

don't understand why anybody would give money to anyone selling a boat that the titles for the boat an motor was not in their name it always is a pain . if you read the small print on the tpwd forms an the trailer registration form it is a second degree felony it the info is not correct on the forms. if you use the boat an have an accident it could be a much bigger problem because you are not the titled owner of the boat.

TP&W is a joke when it comes to registering a boat. Its a pain in the [censored] for used boats. I had to have my parents register mine in Arkansas to get it up to date.

How far away is original owner (who, if I'm reading this right, still owns the boat as far as the state knows)? You might could cut a deal with him. Have him apply for replacement titles, at your cost, then just "sell" you the boat as if the other transactions had never taken place which, according to the state, haven't. Just put the price you paid on the "amount paid" line. Basically just start from scratch with him. Be sure to get a note signed by him authorizing you to appear on his behalf to apply for the replacement titles in his name if you do it in person at a TP&W station. I tried to renew the numbers for a buddy's boat a few years ago and they wouldn't allow me without said letter of authorization.

edited to add: Just re-read a few posts back. If you have the signed titles not appointing a new owner then all you need are the forms signed by the original owner.

I don't recommend this sort of transaction as it's known as "jumping titles" but TP&W makes it so damned difficult sometimes it's just the best route. Basically, you're shorting the state on sales tax they would have received on the transactions between the original owner and you. They don't like that.

All 3 owners violated the law. The original seller is required to print the buyers name and date it. The other 2 owners were required to register the boat in order to own it. They in fact could not sell the boat and were never legal owners without registering it. The boat technically belongs to the original owner. It is a mess for you to have to get cleared up. I would just contact the original owner and explain to him that you bought the boat and because he did not complete the title when he sold it, it is leaving the situation for you and him to make it legal so that he can be released from liability and you can register it. Tell him that you are going to send him a bill of sale for the boat, motor and trailer, breaking down the price you paid for each and ask him to sign it and return it to you. If you can convince him that you are legit and not trying to scam him, I see no reason why he wouldn't just to get his name off of it.

Otherwise go back to your seller and tell him to get what you need or give you your money back until he registers it and can legally sell it.

You can always call a TP&W and speak to someone there. You aren't the first person to go through this and they'll tell you exactly what to do.

I sorted it out. TP&W is very helpful, and easier to deal with than most people give them credit for.

i brought my boat i picked up while stationed in GA there they do not title any thing just registration and i had no bill of sale it was much easier and cheaper then every one told me it would be all i had to do was pay the retitling fee for the boat and motor and trailer i was in and out in 15mins

I called TPW and they told me the world was going to implode and that all of the previous owners committed crimes and I should not have touched the boat. I then mentioned I had all of the titles with only a signature and was told that was all I needed since it was the bill of sale and they were legally still the owner, so I could contact them "but I didn't hear that".

The title of this thread was incorrect, I had blank bills of sale with signatures.
