1. TCEQ is the agency you seek and the one that has been responded to by myself and TPWD. We need to speak up to have TCEQ force LGC to get the nutrient addition to the lake measured and controlled to a level to a level where fish kills will not happen again.
2. LGC's lack of nutrient control resulted in what TPWD thinks is $6,200,000 worth of fish stock. After the nutrient addition is under control LGC should be asked to replace that dead stock in as near a size as possible.
3. Public comments by we anglers in support of TPWD's position is what is needed.
4. Fair treatment LGC needs to fix the damage done to the aquatic stock.

In all fairness, if only nutrient levels are addressed, I fear that the fish kills will continue as they do on other power plant & non power plant lakes. Not on the level as the last big one perhaps but still significant. Then what? Addressing nutrient levels ALONE will not resolve the issue. Fairfield will also need at least 2 bubblers as well. The high water temps produced by the plant in the late Summer months on that small of a lake are too much for certain fish once they reach certain concentrations. That lake was a Texas treasure before the last big fish kill.

TPWD is not blaming high temperatures in their findings. I found some DO data and cited it in my letter comment. The solubility of Disssolved Oxygen in distilled water is about 6 ppm at 112F. Saltier water like the lake has raises that number. This is a very simple technical task to measure for lake all the time.
I agree with your point my comment letter requests the Diural dissolved Oxygen be managed to not drop below say 3 ppm in the low swing overnight. I have no clue if two bubblers is enough and this isn't a sportsman's responsibility. How LGC accomplishs >= 3ppm we do not have to design for them; LGC's system is causing this problem so LGC needs to make the necessary changes. Nutrient control will accomplish most of the DO low swing needs. low enough nutrient levels are being accomplished at Calavaras and Braunig, lakes much further south and west of Fairfield, and suffer worse drought conditions.
So add cliff note item 5: Stop the fish kills! We laymen believe the Diural dissolved Oxygen should be managed to not drop below say 3 ppm in the low swing overnight ( actually a TPWD should affirm this level). LGC together with TPWD needs to decide what the exact minimum Dissolved Oxygen is required and then LGC needs to design and build a system that gets it done. TPWD mentions both 3 ppm and 5 ppm in their comment letter.

Forgive me Don, I think my ADD is getting the better of me, lol. So TCEQ is ignoring TPWD? Why doesn't TPWD seek legal action to force LGC to fix the problem and/or seek restitution? Just doesn't make sense to me. Especially in light of over $6 million! Have any other agencies such as TSSWCB been involved? Seems right up their alley. I can understand your wanting to put pressure on TCEQ for a public comment period. But I can't help think that that is not going to get the desired outcome. I'm happy to email TCEQ, but seems like taking a switch to a gun fight.

TPWD points at TCEQ for the needed changes. What is TSSWCB, and what authorities do they have?

Gotcha. I'm just thinking with all the government and private agencies/organizations out there that deal with water issues maybe they would have more influence. TSSWCB is Texas State Soil and Water Conservation Board. http://www.tsswcb.texas.gov/ There are plenty others, that is just one that came to mind.

Zombie, Sierra Club is CC'd on my comment letter. Double check the first paragraph I editted into my prior post. TCEQ so far shows TPWD's letter shown as received last November. TPWD's letter is at the bottom. TCEQ had the TPWD letter for 5 months and has ignored it so far. emails are not good enough they do not go to where these bureaucrats require it. It has to go onto the comment website I gave you instructions to get to. That site gets your full name, address, and phone number, the TCEQ ID number (WQ0001309000), why the permit is important to you, asks for you position on that ID number item. You need to have requested a hearing on their preliminary decision. Did you ask for a hearing? if you did not do this you fired a blank.
your information will get a notice of a hearing. preamble needs to read something like this: Office of the Chief Clerk (MC 105) Texas Commission on Environmental Quality P.O. Box 13087 Austin, Texas 78711-3087

Barring a Luminant Generating Company rewrite of this permit application and the TCEQ decision I am requesting a contested case hearing with TPWD staff in presence with a meeting period spanning over at least one Saturday so the impacted sportsmen can attend.

Umm, I did go to the site you specified. I copied the number you gave. It did reject my address which happens to me quite often since I live in the boonies. It did allow me to submit it again, regardless. I already got a confirmation.
Now, I told you I was having trouble following exactly what you were after, for crying out loud. I know you probably laid out everything, but I must admit it's lost on me with all the other info in your posts, email, and pm. I guess I need a checklist, bud! You engineer's are all alike, LOL!
